Abstract
The ‘objective approach’ to contract formation and interpretation is one of the firmly established fundamentals of the Anglo-American contract law, pursuant to which parties to a contract (or the negotiations thereof) will be held to the normal and standard meaning of their words or deeds that they outwardly exhibited. This article attempts to provide an overview of the objectivist approach and, in particular, an analysis of how it operates to promote (instead of compromise, as one might suppose) the ideal of party autonomy. This article also addresses the dominance of standard form (i.e., adhesion) contracts in the modern world including the impact thereof on the basic assumptions on which the traditional contract law principles were founded and evaluates the persuasiveness of the latest theories proclaiming that the various conundrums raised by standard contracts and the challenges they are bringing to the conventional contract law frameworks may only be resolved on a consistent and principled manner by resorting to the very fundamentals of the contract law, namely the objective approach.
