임대차임규제에 관한 비교연구 - 한국과 미국의 임대차임규제에 대한 연구를 중심으로 -

초록

본 논문은 임대차임규제와 관련된 법제들을 소개하고 이를 분석하기 위해 작성되었다. 주택임대차와 관련한 기존의 논의들은 보증금을 어떻게 안정적으로 반환받을 수 있는지에 대한 고민과 직간접적으로 연관되어 있다고 판단된다. 이는 높게 설정된 보증금으로 인한 당연한 논리적 귀결이라고 할 수 있다. 그러나 최근 주택시장에서 전세 또는 전세임대차의 비중이 급격히 감소하고 있음은 주지의 사실이며, 이는 일시적인 현상이 아니라 구조적 변화라는 점을 고려한다면, 주택임대차와 관련한 기존의 논의를 확장해야할 필요성이 존재한다고 할 것이다. 본 논문에서는 이러한 필요성에 기반을 두어 임대차임의 통제와 관련된 한국과 미국의 규정들을 살펴보았다. 뿐만 아니라 경제학자들이 임대차임규제에 대한 시각을 함께 소개하였다. 일반적으로 임대차임통제는 최고가격제의 일종으로 이해될 수 있는데, 대부분의 경제학자들은 총후생의 감소 등을 이유로 비판적인 시각을 견지하고 있는 것으로 파악된다. 이와 관련하여 논문에서는 미국의 제1세대 및 제2세대 임대차임 통제기에 지적되었던 경제학자들이 지적한 문제점들을 확인하였다. 다만 개량과 시장에 상황에 따라 검증이 필요하겠지만, 최고가격제가 도입되는 경우 적어도 소비자 잉여는 최고가격제 도입 전보다 더 확대될 여지는 존재할 수 있다는 점을 함께 지적하였다. 이후 주택임대차와 관련하여 중요한 의미를 갖는 미국통일주택임대차법의 개정사항을 정리하였고, 임대차임통제의 법제를 가지고 있는 캘리포니아, 워싱턴 D.C., 메릴랜드, 뉴저지 그리고 뉴욕에서의 규정들을 소개하고, 그들이 가지는 공통점을 확인하였다. 마지막으로 우리 법제의 태도를 민법과 주택임대차보호법을 토대로 살펴보았으며, 임대차임통제에 있어 가지는 한계점들을 지적하였다.

Abstract

In Korea, it was ordinary that tenants paid up to 50-60% of the house price as a deposit to the landlord in so-called Tschonsae. But it is lately not difficult to receive a report, in which the deposit is up to 90 % of house price. This situation is only part of the changes in the Korean housing market. If the Changes are not temporary, we have to prepare for occurring problems because of structural changes in the Korean housing market. One of the occurring problems could be a sharp increase of rent, namely exorbitant rent. In this paper, Article 628 Korean Civil Act (KCA) and Article 7 Korean Housing lease Protection Act (KHLPA), which are translated into English by Korea Legislation Research Institute, are analyzed as a way to respond to exorbitant rent. Article 628 KCA (Right to Demand an Increase or Reduction of Rent) If the rent previously agreed upon by the parties has become unreasonable due to the increase or decrease of the public impost imposed upon the object leased or any other change in the economic situation, either party may demand of the other party to raise or reduce the rent for the future. Article 7 KHLPA (Requests for Increase or Decrease of Rent) If the stipulated rent or deposit becomes unreasonable due to increase or decrease of taxes, public charges and other burdens on the leased house, or a change in the economic circumstances, the party concerned may demand any increase or decrease thereof in the future: Provided, That in cases of an increase, it shall not exceed the ratio set in accordance with the criteria prescribed by Presidential Decree. Considering the precedents in Supreme Court of Korea so far, the applicability of Article 628 KCA is very small. The utility of Article 7 KHLPA is row too, because the term of Lease is just two years according to Article 4 KHLPA. Therefore the rent control system in US is introduced in this paper, because the rent control system in US could be one of the choice alternatives in legislation process.
