AI에 의한 창작물인 발명의 권리 귀속

초록

AI 기술은 4차 산업혁명을 대표하는 기술이고, 이러한 AI 기술이 적용되거나 AI 기술과 결합하여 도출된 창작물을 AI발명으로 간주하여 출원하는 특허출원이 최근 증가하고 있다. 그러나 AI발명의 완성에 인간이 개입한 경우에도 특허출원서에 AI만을 발명자로 기재하여야 하는지, AI발명의 완성에 개입한 인간은 발명자가 될 수 없는 것인지가 쟁점이 되고 있으며, 현행 특허법의 규정과 통상의 특허심사기준을 AI발명에 그대로 적용하여 법리적, 실무적으로 많은 문제점이 발생되고 있다. 현행 특허법 제2조 제1호에 의할 때, AI발명은 발명의 성립성이 인정되어 특허적격성이 인정되지만 특허법 제33조 제1항의 규정에 의해 특허를 받을 수 없는 문제점을 보완하기 위하여 특허법 제2조 제1호 발명의 정의 규정을 개정할 필요가 있다. 또한, 제2조 제1호의 발명의 정의 규정 개정안에 따라 인간의 개입을 통하여 AI가 창작한 발명에 대한 정의 규정을 도입하는 것이 필요하다. 마지막으로, AI발명의 완성에 인간이 개입한 경우에 AI발명의 완성에 개입한 인간을 발명자로 인정하기 위하여 특허법 제33조 제2항을 신설할 필요가 있다.

Abstract

AI technology is a technology representing the 4th industrial revolution, and patent applications for applying for creations derived by applying such AI technology or combining AI technology are recently increasing. However, even if humans intervene in the completion of AI inventions, the issue is whether only AI should be listed as an inventor in the patent application or whether humans involved in the completion of AI inventions cannot be inventors, By applying the provisions of the current patent law and ordinary patent examination standards to AI inventions as they are, there are many legal and practical problems. According to Article 2 Subparagraph 1 of the current Patent Act, the definition of the invention of Article 2 Subparagraph 1 of the Patent Act needs to be revised to compensate for the problem that the AI invention is not patentable under Article 33 Paragraph 1 of the Patent Act. In addition, it is necessary to introduce definition regulations for inventions created by AI through human intervention in accordance with the amendment to the definition regulations of inventions in Article 2 Subparagraph 1. Finally, when humans intervene in the completion of AI inventions, Article 33 Paragraph 2 of the Patent Act needs to be newly established to recognize humans who intervene in the completion of AI inventions as inventors.
