카르텔에 대한 기존연구들은 카르텔의 가격담합행위가 가져오는 산업내의 전략적 “행위”인 가격고정이나 생산량 제한 등과 같은 시장거래의 비효율성에 초점을 맞추어왔다. 그러나 경기변동이나 진입규제에 따른 산업으로의 진입과 퇴출과 같은 “구조”적 측면을 고려해보면, 카르텔은 가격 및 생산량의 통제뿐만 아니라 경쟁기업의 수를 일정하게 제한함으로써 시장의 경쟁구도에 직접적인 영향을 미칠 수 있다. 구체적으로 자유로운 시장진입이 가능한 내생적 시장진입(endogenous entry) 이론의 관점에서 볼 때 시장의 규모가 작거나 혹은 규모의 경제가 큰 산업의 경우 기업간 불완전한 경쟁은 시장내 과다진입(excessive entry)으로 인해 전체적인 사회적 비효율성을 유발시킬 수 있다. 본 연구에서는 자유로운 시장진입이 있는 내생적 시장구조를 바탕으로 카르텔이 불완전한 꾸르노 경쟁균형에서 발생하는 과다진입의 비효율성을 제거함으로써 사회후생을 증진시킬 수 있는 가능성을 제시하고 있다. 따라서 반독점법은 현실적으로 카르텔에 의한 시장경쟁행위의 제한효과를 통제하려는 의도에서 적용하고 있지만, 후생경제적 관점에서 볼 때 특정시장의 진입과 퇴출에 대한 효과를 포함한 내생적 상황을 충분히 반영하여 공정경쟁의 효과를 평가해야 한다.
Abstract
Cartels have long been considered as per se illegal activities since cartels form collusion to monopolize the market and as a result exploit consumers. Most previous researches in the literatures on cartels have focused on the static collusive behaviors of price-fixing agreements. However, the welfare effect of cartels should be re-evaluated under the situation of endogenous market structure with free entry and exit. The purpose of this research is to develop theoretical models which can partially support the efficiency of cartels and to provide a few exceptions against to the applications of cartel regulations. We consider the endogenous market structure with free entry/exit under Cournot competition, and show that the inefficiency of excessive competition under free entry can be reduced by agreements on price and number-of-firms under cartels. In particular, we show that when the fixed cost is large and market demand is relatively small, the economies of scale supports the efficiency of cartels, compared to Cournot competition. As a policy recommendation, it should be taken the entry restriction effect of cartels on market structure into policy considerations of antitrust (fair trade) act, which is applicable to some specific industries.
