니체가 제시한 미적 정의 - 예술생리학과 법철학의 융합을 통한 법미학의 가능성 제고

‘아름답지 않은 정의는 정의가 아니다’라는 법미학의 명제는 정당화될 수 있는가? 니체의 예술생리학과 법철학의 매개는 긍정적 답변을 제시한다. 그 융합구도 속에서 ‘미적 체험의 보편성’ 및 ‘좋음과 옮음과 미적 체험의 동근원성’이 이론적 보증을 받으며, 법감정 및 법적 정의가 미적 체험인 경우가 제시되기 때문이다. 물론 좋음과 옮음과 미적 체험 사이의 교호방식과 갈등해결 장치는 여전히 미제로 남지만, 니체 철학은 법미학의 해체적 유용성이 아닌 생산적 구성성을 주목하게 하는 한 가지 방식일 수 있다.
Abstract
Can the proposition of legal aesthetics that ‘justice which is not beautiful is not justice’ be justified? It is possible by integrating Nietzsche’s physiology of art with legal philosophy. In the framework of integration, the ‘universality of aesthetic experience’ and the ‘same rootedness of goodness and righteousness’ are theoretically supported, and legal experience and legal justice can be aesthetic experience. Leaving the interaction between goodness-and-righteousness and aesthetic experience still unsolved, it is a way to call attention to the productive construction, not destructive usefulness of legal aesthetics.
