니체 철학을 관통하는 큰 주제의 하나는 정의에 대한 고찰이다. 니체 필생의 프 로젝트라 할 만한 정의에 대한 고찰은 크게는 철학사 전반에 대한 정의로운 판단과 이에 근거한 새로운 가치정립이라는 목적을 가지고 있다. 다른 한편 정의의 기원과 경로를 추적하는 그의 노력은 정의와 힘의 관계를 둘러싼 사회철학적 단상들에서 나타난다. 본고는 이 단상들의 분석을 통해 니체의 정의가 사회 역학적이고 정신적인 측면들을 강조하여 법을 단순하게 물리적 힘으로부터 연역하는 고대 자연법사상과는 차이가 있음을 드러낸다. 정의의 토대로써 사회적 관계 속에서 드러나는 힘들의 평가에 근거한 균형의 원리가 강조되고, 이 균형의 유지가 정의의 역할로 규정된다. 역동적인 사회적 관계는 항구적인 균형을 보장하지 않으며, 법적 상태 역시 최종적일 수 없게 된다. 니체에게서 정의는 따라서 진리와 질서를 추구하는 자가 견지해야 할 역동적인 정신의 태도로 밝혀진다.
Abstract
A major theme of Nietzsche's philosophy is the consideration of justice. It has as his life project, on the one hand his just judgments about the entire history of philosophy and a new evaluation based on this as his goal. On the other hand, it shows his concern for the genealogy and the process of justice in the aphorisms on the relationship between justice and power. By analyzing these aphorisms, the present study demonstrates that Nietzsche's justice emphasizes the social dynamics and spiritual aspects of justice and thus exhibits a difference from the old idea of natural law, in which the law arises simply from physical power. As a basis of justice, the principle of balance is stressed, based on the estimation of power in social relations, and the maintenance of this equilibrium is defined as the role of justice. The dynamic social conditions do not guarantee permanent equilibrium, so the legal situation can not be defined. For these reasons Nietzsche's sense of justice is shown in his disposition, which is one of a man who seeks truth and order.
