Abstract

The impact of money extends to not only a simple method of exchange or a measurement of value but it reaches far beyond the infringement of legal interest charges on life, human body and freedom such as in monetary penalty; measure of evaluation, and the cause of the global financial crisis. Especially with the growth of a capitalistic society, money served beyond its economical functions to social·legal functions which freed the individual from the modern era. The purpose of this article is to examine the relationship between money and law by studying the functions and its role of money from the modern society up until today. Though it is acknowledged that there are existing negative perspectives and criticisms in viewing money, this article will focus on the liberation functions of money as Georg Simmel emphasized, and how an individual’s status becomes socially positioned into a higher position. For this reason, this research demonstrates how money historically transformed from monetary calculation to monetary credit especially reviewing its functions, roles and its symbolic significance of the monetary credit. These criticisms become concrete from analyzing the status of money in modern society in terms of the economic, sociological and legal perspectives. Looking beyond the existing economic perspective of viewing money as an exchange method, measurement of value and a means of value-preservation, movement of money(quantity theory of money) confirmed the monetary notions of neutrality by looking beyond the existing economic perspective of viewing money as an exchange method, measurement of value and a means of value-preservation. Also the sociological perspective was presented through the scholastic theories of Karl Marx, Georg Simmel, Max Weber, Talcott Parsons, Niklas Luhmann and Jurgen Habermas. The difference between Marx, Simmel, Weber and Parsons, Luhmann, Habermas is that the formers thought intensely regarding the rationality of individual and the commercialization of personality through money in the beginning of capitalism while the latters focused more ‘rationally’ on the monetary roles and functions by viewing the modernity through the systematic perspective. In a legal perspective, money becomes legalized by the nation state and the monetary value depends on the market. Therefore, in order to carry out the monetary functions as a reasonable payment and an exchange method, an effective free- market is justified. Hence, the regulations on criminal sanction in the legal perspective end up going through the economization (monetization) process in modern order. During this process, the naturalization of economic order, which started from physiocracy, naturalized the market itself through the notion of natural order and the market efficiency and extreme distribution gap of wealth caused by the market draws away from the normative evaluation. Through Beccaria, this research also shows the result on how the reliability of market order expedites the scope expansion of State punishment. Furthermore, law and economic or economic analysis of law continues the shift of physiocracy and utilitarianism which sets the agenda of market order and economic order as one of natural order. And despite of the incommensurability in the cost-benefit analysis, it brings the platform for the economic legal analysis of money to become possible through stating the efficiency as its ideology. Hence, despite of many problems in monetization process, still there are various attempts and efforts to search for the mediation and imaginative method for the possibility of money extinction in order to overcome the obstacles.
