『정치신학』에 나타난 “예외상태”에 대한 슈미트의 이해방식

예외상태라는 문제는 슈미트(C. Schmitt)의 삶과 학문에 있어서 중요한 의의를 가지고 있다. 슈미트가 예외상황이라는 주제에 관하여 학문적 관심을 가지게 된 것은 1919년 독일 헌법 제48조에 따라 바이마르 초대 대통령이었던 에베르트(F. Ebert)가 우익과 공산주의자들에 대항하기 위하여, 심지어는 심각한 경제위기를 해결하기 위하여 비상대권을 광범위하게 사용하였던 정치적 상황 때문이었다. 이러한 상황에서 슈미트는 1920년대에 예외상황과 비상대권이라는 문제를 자신의 학문에 있어서 핵심적인 내용으로 다루는 일련의 저술들을 차례로 내놓았다. 또한 그는 예외상태라는 개념과 관련된 활동을 통하여 정치적으로 성공하게 되었고 나치의 계관학자가 될 수 있었다. 이 글에서는 『정치신학』을 중심으로 예외상태에 관한 슈미트의 논의를 검토하고자 한다. 제2장에서는 슈미트가 “정치신학”이라는 방법을 통하여 예외상태를 강조하고자 하는 이유가 무엇인지 그리고 세속화의 개념이 무엇인지 설명하고자 한다. 그리고 제3장에서는 『정치신학』에서 슈미트가 예외상태의 조건, 결과, 평가 등에 관하여 어떻게 설명하고 있는지 분석하고자 한다. 또한 이러한 설명에 비추어 볼 때 예외상태에 유비되는 기적의 개념이 무엇인지를 검토하고자 한다. 제4장에서는 이러한 슈미트의 설명을 비판적으로 검토해 보고자 한다. 끝으로 제5장에서는 예외상태라는 개념을 둘러싼 슈미트와 벤야민의 관계에 대하여 다루고자 한다.
Abstract
The state of exception had a significance not only in Schmitt's writings but in his life in Weimar. The political situation where the first President of the Weimar Republic, F. Ebert, was using emergency power to overwhelm the Right and communists and even to solve the serious economic crisis according to Article 48 of the German constitution in 1919 made him to became scholarly interested in this concept. He published a series of writings on the state of exception such as Dictatorship(1921), Political Theology(1922), “The Dictatorship of the President of the Reich according to Article 48 of the Weimar Constitution”(1928). Also, he succeeded politically through the activities related to the concept of exception and could become a crown jurist of the Nazi's. This paper aims to examine the debate of C. Schmitt on state of exception based on Political Theology. In Chapter Ⅱ, I will explain the reason why he emphasized the exception through the method of “Political Theology” and the conception of secularization. In Chapter Ⅲ, I will analyze how he explains the conditions, results and evaluation regarding the exception in Political Theology. And I will examine the miracle in theology which analogous to the exception in jurisprudence. In Chapter Ⅳ, I will deal with Schmitt's argument critically. Lastly, I examine how W. Benjamin's work owes Schmitt in its presentation of the exception.
