Abstract

This paper introduces the consolidation of ILO maritime labour instrument. It briefly describes the background of consolidation exercise and the main issues and results of 29th session of the Joint Maritime Commission held in 2001. Then it summarizes most major issues and some contributions made by Korean delegation in the course of development of the maritime labour convention. This summary includes the discussions of 4 meetings of High Level Tripartite Working Group on Maritime Labour Standards and 2 meetings of Tripartite Sub-group on Maritime Labour Standards and the Preparatory Technical Maritime Conference on the Consolidated Maritime Labour Convention. Those major outstanding issues including the scope of application, the requirements of entry into force, complaint handling procedures, applicability of social security regardless of nationality of seafarers, kinds of circumstances justifying detention of ships resulting from port state control, etc. need to be properly addressed with a good spirit of tripartite cooperation. It also points out that the Republic of Korea has faced with considerable criticism because of the fact that so far it has ratified only 2 maritime labour Conventions among 39 maritime labour Conventions bearing in mind that it has the world 8th largest shipping fleet so that it is regarded as one of leading maritime nations and is also a member of the Governing Body of ILO. Therefore seafarers, shipowners and Government need to make common efforts to identify and remove the major obstacles to future ratification of the new consolidated Maritime Labour Convention during the consolidating exercise. Finally the author attempts to summarize what lessons can be learned from the new consolidated Maritime Labour Convention and raises several points, to which all concerned should pay attention, that the new Convention will affect in the maritime sector.
