유엔운시트랄 운송법회의에서 운송인의 책임부분에 대한 논의가 일단락되었다. 운송인은 과실추정주의 책임을 부담하고 운송물에 대한 주의의무와 감항성주의의무를 부담하는 점은 동일하다. 그러나, 기존의 조약에 비하여 운송인의 감항성 주의의무가 항행중에 계속되는 것으로 연장이 되었고 항해과실면책이 폐지된 점등이 큰 차이점이다. 화재면책도 형태를 바꾼 채로 존속되게 되었다. 운송인의 책임제한제도가 인정되는 점은 기존의 해상법체제와 동일하지만 육상운송구간 등에서 발생하는 운송물손상에 대한 책임체제와 실행당사자들의 책임과 면책 등의 문제가 새롭게 다루어지고 있는 점도 유의점이다. 이러한 점은 우리 상법 해상편과는 다른 점으로 앞으로 개정에 참조가 되어야 할 사항이다.
Abstract
UN UNCITRAL Working group meeting for the transport Law completed its discussion on the carrier’s liability at the 14th meeting. The draft instrument maintains the traditional presumed fault liability of the carrier. However, it differs from the current Hague-Visby Rule and Korean Commercial Code in that (1) it makes the seaworthiness obligation of the carrier continuous throughout the voyage；(2) the carrier’s exemption from the liability caused by the error of the navigation is deleted；(3) the fire exemption is also slightly modified but remained as one of exemption.The instrument newly adopts liability regime in the subsequent carriage before and after sea carriage and between the carrier and performing parties. The new instrument should be regarded as a promising convention draft to be taken into consideration in relation to the revising project of Korean Commercial Code.
