중국의 유탁손해배상제도에 관한 연구

우리의 최대교역국인 중국은 해양오염 특히 유탁오염손해를 함께 입을 가능성이 있어 중국의 유탁손해배상제도에 대한 연구는 간과하여서는 아니 될 것으로 생각된다. 이에 중국의 해양환경보호법과 해법전 등의 법제를 중심으로 국제협약과의 비교를 통하여 실효성있는 손해전보를 위한 CLC 수준의 배상기준의 마련과 펀드협약에의 가입 등과 관련하여 고찰하였다. 현행 중국법제도의 문제로는 연안 및 내수운항을 하는 유조선의 강제보험에의 가입의 미흡과 중국이 펀드협약의 당사자가 아니라는 점 등을 들 수 있다. 끝으로 중국에 있어서의 유탁손해배상제도를 향상시키기 위한 약간의 방안도 모색하여 보고자 한다.
Abstract
The Study on Compensation for Oil Pollution Damages in China is need, because Korea is apt to share marine pollution, especailly oil pollution, with its biggest business counterpart, China. This article discusses China's establishment of oil pollution compensation up to CLC level and the accession to Fund Convention, with the comparison between the international conventions and Chinese law. China has some problems, such as the lack of compulsory insurance of tankers for offshore and inland water navigation and being not the party to Fund Convention. Some policy for the improvement of oil pollution compensation in China is suggested.
