2003 국제선박보험약관과 한국해운조합의 선박공제보통약관의 일부 조문 비교에 관한 연구

전 세계적으로 선박보험에 관한 표준약관으로서의 기능을 했던 1983 ITCH가 제정된 지 20여년이 경과된 2003년에 보다 현대화된 형태의 국제선박보험약관을 제정하였다. 총 3부 50개 조항으로 확대되어 제정된 국제선박보험약관은 워런티에 관한 내용을 완화하고, 담보범위를 확대하였다. 추정전손 요건을 완화하고 실무상 사용되어 오던 특별약관이나 주요 문언을 직접 약관조항에 반영하기도 했다. 반면 피보험자의 통지의무가 강화된 점도 있다. 1949년에 설립된 한국해운조합은 1983 ITCH의 영향을 받아 만들어진 현행 ‘선박공제보통약관’을 개정하기 위한 준비 작업을 벌이고 있다. 1983 ITCH를 대체할 목적으로 제정된 2003 IHC의 각 내용은 선박공제보통약관 개정에 적지 않은 시사점을 줄 것으로 판단한다. 선박공제보통약관을 개정함에 있어 다음과 같은 점을 고려해야 한다. 조합의 담보범위를 보다 확대하고, 면책사유에 대해서는 이를 명확히 할 필요가 있다. 충돌손해배상책임과 관련하여 직접청구권과 선지급 항변과의 관계에 대해서 이를 명확히 하되 직접청구권에 우선권을 두도록 해야 할 것이다. 공제료 납부와 관련하여서는 최고기간, 해지 통보 등의 내용 추가를 고려해야 할 것이며, 사고통보와 관련하여 기산점에 대해서도 개정이 필요하다고 판단된다. 마지막으로 2003 IHC와 마찬가지로 협정보험가액의 80%를 수리완료 후의 가액으로 간주하는 것으로 개정함으로써 조합의 담보범위를 확대해야 할 것이다.
Abstract
The ITCH of 1983 had been used as the standardized clause of insurance for hull insurance for 20 years until 2003 when the more modernized International Hul Clauses were prepared. This new International Hull Clauses were composed of three sections and 50 clauses, with the warranty terms alleviated a little but the risk coverage expanded. They also alleviated the requirements of constructive total loss but put the special clauses and wording which had been used in practices up to then into their terms and conditions. On the other hand, they have stricter duty to notice by the insured. Korean Shipping Association which were established in 1949 started to revise the current “Ship Mutual Insurance Clauses” which were affected by ITCH of 1983. The contents of 2003 IHC, which is the replacement of 1983 ITCH, are likely to greatly affect the contents of revised Ship Mutual Insurance Clauses. The followings shall be considered in revising the Ship Mutual Insurance Clauses. The risk coverage needs to be expanded and the exclusion clauses shall be more specific. Related to the compensation liability of collision, the direct right of action and the defense of pay to be paid rule shall be more specific with priority put on the direct right of action. As far as the payment of premium is concerned, the period of peremptory notice and notice of termination shall be added to be more specific. Also the revision is required to the starting point of reckoning and the effect of breach of duty related to the notice of accident. Finally, the risk coverage needs to be expanded as in case of 2003 IHC in which the 80% of the agreed insurable value is deemed to be the value after completion of repair.
