미국의 정치철학자 마이클 샌델(Michael J. Sandel)은 흔히 자유주의에 대항하는 공동체주의의 대표자 가운데 한 명으로 인식된다. 그러나 샌델 자신은 여러 저작에서 전통적인 공동체주의자가 아니라고 강조한다. 오히려 자신은 자유주의자에 더 가깝다고 말하기도 한다. 이러한 이유에서 샌델의 정치철학은 ‘자유주의적 공동체주의’라고 규정하는 것이 더욱 정확하다는 주장이 제기되기도 한다. 그러면 어떤 점에서 샌델의 정치철학은 한편으로는 공동체주의적인 철학이면서, 다른 한편으로는 전통적인 공동체주의와는 구별되는 자유주의적 속성을 지니고 있다고 말할 수 있는가? 이 글은 바로 이러한 의문에서 출발한다. 이 의문을 해명하기 위해 이 글은 다음과 같이 논의를 전개한다. 먼저 국내에서 밀리언셀러가 되었던 샌델의 『정의란 무엇인가』 및 샌델이 지금까지 출간한 저작을 바탕으로 하여 샌델의 정치철학을 개관한다(II). 이어서 어떤 점에서 샌델의 정치철학을 공동체주의에 속한다고 말할 수 있는지 살펴본다(III). 여기서는 특히 샌델이 박사학위논문에서 강조한 ‘옳음에 대한 좋음의 우선성’과 롤스의 무연고적 자아에 대한 비판을 집중적으로 다룬다. 다음으로 어떤 점에서 샌델의 정치철학을 자유주의적이라고 말할 수 있는지 검토한다(IV). 여기서는 샌델이 집단적 다수주의를 거부한다는 점 그리고 시민의 적극적 참여와 토론을 강조한다는 점이 부각된다. 마지막으로 샌델의 정치철학이 어떤 의미와 한계를 지니는지 보여준다(V).
Abstract
The American political philosopher Michael J. Sandel is often recognized as one of the most important communitarian philosophers that are against the Liberals. However, Sandel himself emphasizes in his works that he is not a traditional communitarian. Sandel says that he is the more liberal himself rather than the communitarian. For this reason, it may be argued that Sandel’s political philosophy is not one of communitarianism, but ‘liberal communitarianism.’ If then, we may ask questions of what makes his political philosophy communitarian on the one hand and liberal on the other hand. This article begins with this questions and aims to deal with this questions as follows: At first, based upon his bestseller Justice and other works published so far, this article makes a overview of Sandel’s political philosophy (II). Next, this article deals with the question of what makes his political philosophy communitarian (III). Here ‘the priority of the good over the right’ which Sandel argues in his doctoral dissertation Liberalism and the Limits of Justice and his critique of Rawl’s concept of ‘unencumbered self’ are mainly discussed. Furthermore, this article handles the question of what makes Sandel’s political philosophy liberal (IV). It becomes here highlighted that Sandel is denying majoritarianism and emphasizing active participation and discussion of citizen. Lastly, this article tries to show the products and limits of Sandel’s political philosophy (V).
