Abstract
Global warming is the one of environmental problems to be solved by human-beings these days. Due to the global warming, physical changes are ongoing in the Arctic and human activity is increasing there. The prospect of new shipping routes, expanded oil and gas development, and new commercial fishing might generate environmental impacts in the Arctic. Therefore there is a need to restrict and regulate navigations in the Arctic. But there must be international regulatory uniformity to reconcile the principle of freedom of navigation with environmental protection and safety interest. The United Nations Convention on the Law of the Sea(UNCLOS) provides the obligation of States to protect marine environment and cooperate on a global and regional basis in formulating international rules for the protection of the marine environment. And UNCLOS seems to give the coastal states of ice-covered sea areas the necessary powers to prevent vessel source pollution. International rules relating the marine pollution from ships have been established by the International Maritime Organization. It adopted International Code for Ships Operating in Polar Waters(Polar Code) to amend the MARPOL 73/38 and SOLAS. Canada promulgated to protect Canada’s Arctic waters beyond territorial seas through Arctic Waters Pollution Prevention Act(AWPPA) in 1970. Canada has also operated Northern Canada Vessel Traffic Services Zone Regulations(NORDREG), ship reporting system and vessel traffic services. The Arctic Shipping Safety and Pollution Prevention Regulations(ASSPPR) was adopted to regulate the safety and pollution from ships in the Arctic. Some commentators are concerned that Canadian regulations are inconsistent with international law. It is desirable that the international organization like IMO makes uniform standards to protect the Arctic Ocean marine environment. And IMO could designate the Arctic as Special Areas or Particularly Sensitive Sea Areas to protect the Arctic. There are also needs a regional treaty arrangement to be the strong basis of a management framework capable of protecting the Arctic.
