스토킹의 개념과 처벌에 관한 몇 가지 제언

근래 우리 사회에서는 이른 바 “가락동 살인사건”과 같은 심각한 스토킹 피해 사건이 발생하면서, 스토킹 피해의 심각성과 처벌 필요성에 대한 인식이 생겨났다. 1999년 15대 국회부터 19대 국회까지 다수의 법안이 발의되었으나, 입법으로 이루어지지 못했다. 최근 현 정부 차원에서도 입법의 필요성이 제기되어 왔고, 이미 20대 국회에서는 2017년 6월 현재 다섯 건의 관련 법안이 발의되었다. 더 이상 스토킹과 그로 인한 피해를 묵과할 수 없다는 문제의식이 그 이유일 터이다. 스토킹은 피해자의 사생활의 비밀을 침해하고, 의사결정과 활동의 자유를 침해한다. 따라서 형사 처벌이 불가피한 경우가 존재하는데, 현행과 같이 스토킹에 경범죄 처벌법으로만 규제하는 것은 부족하다. 입법을 통한 보완이 필요하다. 이에 본고에서는 스토킹의 개념을 살피고, 외국의 입법례 입법에 앞서 생각해보아야 할 것들과, 입법에 대한 제언을 더하였다.
Abstract
In recent years, serious stalking accident such as “Karadong Murder” have occurred in Korean society, resulting in the recognition of the seriousness of stalking damage and the necessity of punishment. In 1999, many of bills have been prepared from the 15th to the 19th National Assembly, but failed to proceed to legislative. Recently, the need for legislation has been being raised from a government level, so in the 20th National Assembly related bills have been sponsored as of June 2017. It was due to recognition that our society shouldn’t overlook any more the harm caused by stalking. Stalking violates victim’s privacy, freedom of decision making and activity. Therefore, criminal punishment for the offender is inevitable. It is not sufficient to regulate stalking only by the Misdemeanor Punishment Act. Legislation needs to be supplemented. In this thesis, I examined the concept of stalking and suggested a few ideas about legislation.
