경찰활동은 개인의 재산권 행사나 행동의 자유를 제한하는 경우가 많아서 집행과정에서 논란과 갈등의 소지가 반발의 강도도 높게 나타난다. 경찰의 법집행력의 강화내지 엄정함은 사회질서를 유지하는데 중요하며 경찰법집행력의 약화는 직간접적으로 국민의 안녕과 평온을 해치는 결과를 가져오게 된다. 경찰법집행력을 강화하고 엄정하게 하기 위해서는 경찰법집행의 대상이 되는 국민들의 경찰활동에 대한 순응의 정도가 중요하다. 최근 일부국민들의 왜곡된 인권인식이 법을 준수하지 않고 경찰의 법 집행에도 순응하지 않거나 정당한 공무집행을 방해하는 사례가 빈번히 발생하고 있어서 우려의 목소리가 커지고 있어서 경찰의 법집행에 대한 국민들의 순응도를 제고하기 위한 노력이 필요하다. 본 연구의 목적은 경찰의 법집행에 대한 이론적 검토와 함께 경찰의 법집행 실태를 분석해 보고 경찰의 법집행에 대한 국민 순응도 향상방향을 제시하는데 있다. 경찰의 법집행에 대한 국민순응도를 제고하기 위해서는 지역사회 경찰활동을 통한 시민과의 파트너쉽 강화 등 시민들로부터 신뢰를 확보하고자 하는 노력이 필요하다. 이를 위해서 경찰의 시민에 대한 인식 전환과 경찰 조직내의 부정부패나 비리의 청산과 같이 경찰이미지를 제고 할 필요가 있다. 이와 아울러 경찰관 직무집행법 등의 보완을 통하여 경찰법 집행의 실질적인 활동을 담보 할 필요가 있다.
Abstract
It is important to citizen’s adaption on police activity to reinforce police law enforcement. Recently, some of the citizen’s possess incorrect human rights awareness, breach the law, and disturb resonable police law enforcement. Therefore, it is developed national issues. An object of this study is to improve citizen’s adaption to police law enforcement by analyzing actual condition of police law enforcement and theoretical consideration on police law enforcement. This study, an introduction is at the chapterⅠ, theoretical consideration of police law enforcement at the chapterⅡ, actual condition of police law enforcement at the chapterⅢ, an improvement of citizen’s adaption to law enforcement at the chapterⅣ, and a conclusion at the chapterⅤ. In conclusion, it is necessary to improve of citizen’s adaption to police law enforcement that development of based program which is based on confidence between police and community, reinforcement of police-to- public information service, prevention of police corruption, securing of fairness and rigidity of police law enforcement, and development of law and system related to police law enforcement.
