화이트칼라 계층의 폭력성에 관한 연구 : ‘레드칼라(Red-Collar)’범죄를 중심으로

초록

최근 김형식 전 서울시의원의 수뢰 은폐 목적 살인청부 사건, 그리고 모 대학 교수가 제자를 자신이 대표로 있는 학회 사무국에 취업시켜 일을 시키면서 수년간에 걸쳐 폭행하고 인분을 먹이는 등 엽기적인 학대를 자행한 소위 인분교수 사건이 발각되어 세상을 경악케 하였다. 그간 범죄학계에서는 화이트칼라 범죄자 내지 화이트칼라 계층 근로자의 성격적 특징이나 폭력성에 대해서는 관심이 비교적 적은 편이었다. 그러나 최근 들어 서덜랜드가 주창했던 화이트칼라 범죄의 특징들을 무색케 할 정도의 폭력성향이 사회 상류층 내지 화이트칼라 계층 근로자들에게서 발현되는 사례가 눈에 띄게 늘어나고 있으며, 서구에서는 소위 ‘레드칼라(Red-Collar)’ 범죄라는 새로운 범죄유형까지 등장하는 등 이 분야에 대한 관심이 고조되고 있다. 국내에서도 위의 김 前 의원 살인청부 사건이나 소위 인분교수 사건 등을 비롯하여 화이트칼라 계층 근로자의 강력 또는 폭력범죄가 갈수록 기승을 부리고 있다. 그러나 그 발생 원인이나 대책 등에 대한 국내 논의는 아직 찾아보기가 어려운 실정이다. 이 연구에서는 화이트칼라 범죄의 기본 개념을 정리한 후 그간 등한시되었던 화이트칼라 범죄자의 성격적 특징과 화이트칼라 계층 근로자의 폭력성에 대하여 살펴보았다. 또한, 미국 등 서구에서 발생빈도가 점증하고 있는 화이트칼라 범죄와 폭력범죄의 연계 현상 즉 소위 레드칼라 범죄 및 사기은폐살인(Fraud-Detection Homicide) 등 신종 범죄 유형을 소개하고 화이트칼라 범죄의 원인에 대한 새로운 접근, 화이트칼라 계층의 폭력성에 대한 인식 전환 등에 대해 심층 논의하였다.

Abstract

We were recently so shocked by an ex-city councilor's contract killing case for the concealment of taking bribes and a case of an professor who committed a grotesque maltreatment of his pupil such as assaulting and feeding a human excrement for several years. Meanwhile, the crime academia has tended to have relatively less interest in personality characteristic or violence of white-collar workers as individuals. However, a research on the so-called 'red-collar' crime is gradually becoming active in the West. Violent crimes by white-collar criminals or white-collar workers are on the increase day by day even in Korea. Nevertheless, it is hard to find a discussion about a cause or a countermeasure for its occurrence. This study examined about the definition of white-collar crime and about the violent propensity of white-collar workers that has been neglected in the meantime. In Western countries, in-depth discussions were made focusing on 'red-collar' crime. Finally, the controversial issues were arranged in relation to new approach on the causes of white-collar crime, violent personality of white-collar workers, and the criminal psychological characteristics of 'red-collar' crime.
