Abstract
Since a discussion about a white-collar crime was begun by Sutherland, the unproductive dispute has been lasted for a long time in the academic circles related to the definition of its concept. However, there have been different opinions even so far about whether the white-collar crime will be defined focusing on the offender or the offence. According to the continuation of this conceptual argument, cases that attempt the specific type classification are also being grown instead of the abstract definition controversy over a white-collar crime. The white-collar crime of the day is being added its seriousness such as getting intelligent and diversified day by day. There is likely no special doubt that some elements of being applied in common exist clearly between various types of white-collar crimes in this way. If so, there is a need to newly define a concept of a white-collar crime based on this through seeking common elements of white-collar crimes, and to establish a criminal type on the basis of this. Hence, this study re-defined a concept of a white-collar crime from the perspective of criminal normative science, and attempted new type classification. Especially, the application was made a concept of ‘Rechtsgut(the benefit and protection of the law)’ to a part of the offence, and a concept of ‘white-collar worker’ to of the offender. As a result, the white-collar crime was defined as infringement of individual․national․social ‘Rechtsgut’ that white-collar workers in the public or private sector or organizations conducts with a method such as abuse of power, deceit, breach of trust in order to pursue tangible․intangible personal or organizational benefit. Also, types of white-collar crime are classified into (i) infringement of individual Rechtsgut․national Rechtsgut․social Rechtsgut committed by a white-collar worker in the public sector, (ii) infringement of individual Rechtsgut․national Rechtsgut․social Rechtsgut committed by a white-collar worker in the private sector, (iii) infringement of individual Rechtsgut․national Rechtsgut․social Rechtsgut committed by an organization.
