중소기업의 경영혁신을 지원하는 일본의 최근 입법 동향

중소기업은 지역 경제를 지탱하고, 공급사슬에서 중요한 위치를 차지하는 우리 경제의 근간이다. 이 점에서 중소기업의 지속적 성장은 우리 경제의 지속적 성장으로 이어질 수 있는 중요한 문제이다. 그러나 최근 중소기업의 현황을 보면, 그 미래가 밝지만은 않다. 중소기업의 상당수가 적극적인 구인에도 구직자의 기피 등으로 인해 인력난을 겪고 있고, 낮은 생산성으로 인해 자생력을 점차 잃어가고 있기 때문이다. 다만 정보통신 분야에 등장한 새로운 기술 예컨대, 인공지능(AI), 사물인터넷(IoT), 빅데이터 등으로 인해 단기간에 파괴적 혁신을 실현할 수 있는 환경이 형성된 만큼, 중소기업이 공격적인 경영혁신을 통해 단기간에 생산성을 향상하거나 새로운 사업모델을 개척함으로써 경영상 애로를 극복하고 지속적 성장의 활로를 찾는 것이 불가능한 것은 아니다. 본 논문은 중소기업이 경영혁신을 통해 새로운 도약의 길로 나아가길 바라는 마음에, 중소기업의 경영혁신을 과감히 지원하는 법·제도 정비를 염두에 두고 우리에게 시사하는 바가 있는 일본의 입법 동향을 면밀히 검토하는 기초 연구를 하였다.
Abstract
In June 2018, the government released an agreement to mediate investigative rights between prosecutors and police. The long-standing dispute over the adjustment of investigative rights stems from the purpose of prosecution reform. And the reform of prosecution should ultimately be aimed at defending and enhancing the interests of the people. In view of these two objectives, the agreement ended in a jumble, lost direction beyond its original purpose. This is because in the process of reaching an agreement, the political compromise and agreement between the prosecution and the police, or the Ministry of Justice and the Ministry of the Interior and Safety, came before the original purpose and the nature of the judicial process. From the perspective of the prosecution's reform, the agreement cannot be called a proper division of the prosecution's authority and a measure to prevent the use of biased authority. In addition, from the perspective of the interests of the people, it cannot be called a reform plan because the human rights infringement structure currently under investigation by the police and prosecutors is likely to remain intact or worse. This article examines the issue of agreement that abolishes the prosecution's right to command investigation and gives the police the right to end the investigation. After that points this article the problems of the current dual- and double-investigation structure, which the prosecution and police investigate separately and twice. As a way to overcome these problems, it proposes a reasonable investigation structure, in that the police are investigating and the prosecution directs the police investigation. In addition reviews this paper introducing a local police system and structural separating the judicial police from administrative police in order to prevent police concentration.
