Abstract

The term 'corporate social responsibility(CSR)' has been used in various fields such as business administration, social studies, philosophy, law and so on. Among them, the research achievements of business administration are very remarkable, so that the other studies are referring to their works a lot. But now, the issue CSR is becoming a kind of legal problem every enterprise faces that wishes to be respected by civil society. This is a world-wide trend which not a few major international network groups concerned(for example, Global Reporting Initiative, International Standards Organization) are making with their much effort. This paper is a trial of legal reproaching to the CSR and to the occupational health and safety(OHS) issues as a CSR perspective. To setting up the basic legal concept of CSR, this article refers to the legislative cases of Denmark and the United Kingdom, which have the Acts containing CSR programs. This paper suggests a concept of 'corporate social obligation' instead of corporate social responsibility. Even though there may be a lot of matters in OHS as a CSR scope, G3 guideline makes a OHS proposal as follow that is generally acceptable. ① Percentage of total workforce represented in formal joint management-worker health and safety committees that help monitor and advise on occupational health and safety programs, ② Rates of injury, occupational diseases, lost days, and absenteeism, and total number of work-related fatalities by region, ③ Education, training, counseling, prevention, and risk-control programs in place to assist workforce members, their families, or community members regarding serious diseases, ④ Health and safety topics covered in formal agreements with trade unions. To guarantee the implementation of CSR details, this study suggests the public disclosure system. The public disclosure about the fundamental OHS information helps the enterprises make greater efforts to improve the condition of work places and employees' health.
