Abstract
Since 2011, the government has enforced Shutdown program, and it also decided to introduce cooling off program as one of the solution to eradicate violence in school. As a result, regulation on the Internet game for minors has arisen as an issue in the society. However, US Supreme Court declared uncostituionality of California’s laws to restrict sale and rent of violent video game to Minors in June 2011. Actually California tried to enforce the said law in 2005, but the court granted a preliminary injunction against the said law since it is not constitutional. US Supreme Court found that even violent video game is entertainment as part of protected speech, and minor’s right to access to it is protected freedom of speech under the case law below. Contents-based regulation should be under the strict scrutiny standard. The government should bear of burden of proof in the strict scrutiny standard. There are three requirement in strict scrutiny standard: (a) government’s compelling interest, (b) least restrictive means to achieve the government’s compelling interest, (c) direct causation between the compelling interest of government and least restrictive means. The vagueness doctrine and overbreadth doctrine functions as internal standard of interpretation. The case law is analogous to the principle of the prohibition of excessive restriction (Section 2 of Article 37 in Korean Constitution) and the principle of definitude as a content of a law-governed country respectively. The standard of scrutiny of unconstitutionality in the US seems to be analogous to it of Korea. However, the burden of proof shifted to the government in the US while the victim bears it in Korea. To conclude, the strict scrutiny standard against video game regulation for minors is not irrelavant to Korea since modern society of Information like Internet is characterized as openness. Especially present regulation on the harmful matters to minors such as computer game and etc is contents-based restriction. The US case law above is basically applicable to Korea. Thus ‘shutdown program’ and ‘cooling off program’ may not be constitutional since they fundamentally prevent minors from accessing to Internet game itself during fixed time.
