Abstract
In year 2001, The 7 Circuit Court has struck down 9 cases as violent games, one of which is American Amusement Machine v. Kendrick. In Kendrick, the 7th circuit court struck down the district court decision, invalidating an Indianapolis ordinance which restricted the sale of the video games whose contents include “graphic violence”. This study focuses on the comparative analysis of the circuit courts' decisions as well as scrutinizes the Supreme Court decision, Brown vs. Entertainment Merchants Association 131 S.Ct. 2729 (2011). In Brown, the Court's plurality has been written by Justice Antonin Scalia, joined by Justice Ginsburg, Kennedy, Sotomayor, Kagan. This case is the final and supreme decision, which is important, because it analyzes the relation between the video games and the violence of youth who spend time with the violent video game. Since Brown case will give rise to deeper discussions of the current issue in terms of the right to speech and interactive nature of video games, hence this article will play an important role to encourage the discussions of the violent video game and the right to speech further.
