Abstract

A case of digital sexual exploitation, called the ‘Nth Room’ incident, shook the Republic of Korea. After this incident, public opinion exploded, and the so-called ‘Nth Room’ Prevention Act was passed by the National Assembly. Some amendment bills such as the 「Sexual Violence Punishment Act」, one of the ‘Nth Room’ prevention laws, recognize digital sex crimes as serious crimes, and the legal punishment for this has been increased. In particular, Article 14, Paragraph 4 of the same law has been newly added, which stipulates that “a person who possesses, purchases, stores, or watches” shall be punished by imprisonment with labor for not more than three years or by a fine not exceeding 30 million won. The purpose of this is to surely eradicate illegal filming by punishing consumers as well. In major foreign countries, it is not a crime to simply watch illegally filmed images of adults. Not only that, but it is predictable by stipulating relatively clearly, such as limiting the subject of the filming that is punishable to a secret part. However, in our country’s “Sexual Violence Punishment Act,” the punishment rules for viewing acts are abstract, so the scope of their application can be very broad. Watching is also subject to punishment. Therefore, even private monitoring activities to block or delete illegally filmed footage are shrinking. In the case of Nuricops, which is operated by the National Police Agency among private organizations, the number of reports of monitoring of illegally filmed footage increased from 50,000 in 2020 to about 3,000 in 2021, only 6% of the previous year. The new law to eradicate illegally filmed films has produced contradictory results, such as obstructing the crackdown on illegally filmed content or weakening the intensity of the crackdown. In addition, there is a lot of controversy over the interpretation of the punishment rules for viewing acts under the Sexual Violence Punishment Act because the rules for intentional offenders are not clear. This study aims to suggest a desirable direction for interpretation by examining foreign regulations related to illegally filmed films and analyzing the components of the punishment regulations for viewing acts under the Sexual Violence Punishment Act. On the other hand, after examining whether the cyber monitoring activities of private organizations can be grounds for illegality in the punishment regulations for viewing acts under the Sexual Violence Punishment Act, through an analysis of related precedents, activate private monitoring so that the punishment regulations for viewing behaviors can be applied accordingly. We would like to propose an institutional and legislative improvement plan for
