이 연구는 선거구 획정 절차와 내용의 민주성 제고방안을 연구 목표로 현행법상의 문제점을 진단하고, 해외 사례와 법 등을 비교하여 대안을 제언하였다. 그동안 우리나라에 선거구 획정위원회의 실질적인 독립성‧중립성 확보에 관련한 선행연구는 극소수인 것으로 파악되고, 관련 연구가 부족한 탓에 많은 논의와 대안이 부족했던 것으로 보인다. 이 연구에서는 우리나라 선거구 획정 절차와 내용이 민주주의와 국민주권에 부합하기 위한 다양한 분석과 대안을 도출하였다. 비결정형식으로 되어 있는 인구편차 허용한계 기준을 명확하게 「공직선거법」에 명시할 것, 현직의원의 선거구 획정에 대한 개입을 최대한 배제할 것, 강화된 시민참여형 선거구 획정위원회의 장단점 소개, 호주와 영국, 미국형 독립적 선거구 획정위원회 소개, 해외 선거구획정위원회 위원 구성의 다양한 전문성 활용, 우리나라가 선거구 획정안을 6개월 정도 만에 도출하도록 법제화되어 있는 것과 달리 영국과 독일은 2년 이상의 장기간 동안 선거구 획정안을 마련하는 점, 선거구 획정에 대한 보편적인 교육이 선행되어야 실질적 국민참여가 이루어질 수 있다는 점, 선거구 획정시 알고리즘 등 기술 적용으로 산술적 정확도를 높임으로써 공정성을 제고할 수도 있지만, 컴퓨터에 의한 선거구 왜곡 가능성을 고려하여 도입에 신중하여야 한다는 점, 선거구 획정위원을 구성할 때 헌법적으로 중립성을 보장 받고 중립적이어야 할 의무를 지는 다양한 전문성을 가진 공무원들을 위원으로 임명하는 것이 바람직하고, 전문가들은 영국 사례처럼 자문위원으로서 임명하여 활용하는 것이 참조할만한 모델이 될 수 있을 것이라는 점을 제시하였다.
Abstract
This study aims to enhance the democratic nature of the electoral districting process and content. It diagnoses issues within the current legal framework and proposes alternatives by comparing international cases and laws. There has been a scarcity of previous research on securing the substantial independence and neutrality of the Electoral Districting Commission in South Korea, leading to a lack of discussions and alternatives. This study derives various analyses and alternatives to ensure that the electoral districting process and content in South Korea align with democracy and national sovereignty. The study suggests several measures: Clarifying the permissible population deviation limits within the Public Official Election Act. Minimizing the involvement of incumbent legislators in the districting process. Introducing the advantages and disadvantages of enhanced citizen-participation electoral districting commissions. Presenting independent electoral districting commissions in Australia, the UK, and the US. Utilizing diverse expertise in the composition of international electoral districting commissions. Noting the contrast between South Korea, where the law mandates a six-month period for drawing up electoral districts, and the UK and Germany, where the process takes over two years. Emphasizing that general education on districting must precede to achieve substantial public participation. Highlighting that while applying algorithms and other technologies in districting can increase arithmetic accuracy and fairness, the potential for computer-driven gerrymandering necessitates cautious implementation. Recommending that electoral districting commissioners should be appointed from various professionals who are constitutionally guaranteed to be neutral and bear a duty of neutrality. Experts could be appointed additionally as advisors, following the UK model.
