이 글은 해외 선거구 획정제도와 제도의 적용사례에 관한 정보를 제공함으로써, 헌법재판소 선거구 인구편차 조정 판결 이후 선거구 재획정이 정치의제가 되어 있는 2015년 한국적 현실에 유의미한 함의를 찾아보는데 목적이 있다. 이 글의 본문은 2개의 장으로 구성된다. 제2장은 선거구획정제도의 하위유형들과 관련 해외사례를 소개하며, 제3장은 영국, 독일, 일본, 프랑스의 제도 적용 사례를 분석하고 있다. 제도 적용 사례를 통해, 모범적인 선거구획정 제도를 갖추고 있다고 평가되는 영국과 독일에서도 선거구획정은 다수 행위자들의 이해관계가 결합된 갈등적인 정치과정으로서 종종 제도 적용의 어려움에 직면해 왔다는 사실을 확인할 수 있다. 그러나 어렵더라도 정치사회적 합의가 가능한 규칙을 마련하고 규칙의 변경이나 새로운 규칙 마련의 정치과정을 통해 갈등을 해결하고자 했던 영국, 독일과는 달리, 일본이나 프랑스 사례는 제도적 갈등해결절차가 제대로 마련되어 있지 않거나 작동하지 않음으로써 파국적 정치 갈등이 전개되었다는 점에서 대조를 이룬다. 선거구획정 제도 자체가 불완전하고 제도 적용에서 행위자들의 재량권이 너무 크게 허용되어 있는 한국적 조건은, 선거구 획정을 둘러싼 정치 갈등을 제도적으로 해결해 나가기 어렵게 만든다. 이제부터라도 합의가 가능한 규칙들을 만들고 정치행위자들이 그 규칙에 승복함으로써 유권자들의 신뢰를 형성해나가야 할 것으로 판단된다.
Abstract
This paper provides the informations of the electoral boundary delimitation institutions and the cases of their applications, and looks for the implications that they transmit to Korea after the constitutional court’s verdict of the electoral re-districting. The body paragraphs of this paper are composed of two parts. The first part provides the sub-types of boundary delimitation institution and the cases adopting the sub-type institutions. The second part analyses the institution’s application cases of UK, Germany, Japan and France. Through the second part, we can find that the countries have faced the difficulties of the applications and the re-districting is the coordination process of the various political conflicts. But in contrast to UK and Germany that have made the rules and sought to solve the political conflicts through the institution, Japan and France have faced even more serious political conflicts. The Korean situation has a resemblance to Japan or France. The re-districting institution is incomplete and the political agents have a strong discretionary power. An effort making procedures where a consensus is possible is needed.
