현행 보안관찰제도의 대안적 모형에 관한 연구

Abstract

A Study on the Alternative Model ofSecurity Observation SystemChoi, Eung RyulJung, Woo IlCha, Hoon JinThe Security Observation System is enacted to adjudicate the security observation decision against the offenders who have violated the security observation matters such as the National Security Act or rebellion clause in the Criminal Law. Also, the Security Observation System regulates the execution of the security observation cases in order to prevent the recidivism and assist the rehabilitation of offenders.The Security Observation Act in existence was established as an alternative legislation on the Society Security Act. Even though there was much improvement compare to the Society Security Act, the Security Observation Act was still criticized on the infringements of human rights. Therefore someone argues that the Security Observation Act must be abolished.Considering the separated South and North Korean situations and unstable global political situations, it would be more appropriate to revise the current Security Observation Act in its human right matters rather than the abolishment of the entire Security Observation Act.Based on the examination of Security Observation system, this study proposes the several recommendations with tree alternative models.
