미국에서의 교회와 국가의 관계에서, 중심적 주제가 되는 “정교 분리”의 문제를, 필자는“서양 법 전통”의 오랜 문명사라는 세계사 적인 관점에서 바라보려고 하였다. 그래서 아메리카의 교회와 국가의 인류사 적인 연원이 되는, 17세기의 유럽, 17세기의 뉴 잉글랜드 식민지의 역사에 소급하였고, 비단 프로테스탄트 혁명이후의 유럽뿐 아니라, 종교 개혁이전의 교회와 국가의 관계가 기원후 5세기에서 15세기의 중세 동안 서양법 전통의 문명사에 끼친 영향부터 보려 하였다. 서양 세계의 정교 분리의 역사는 실로 “ 양검 이론 ”이후, 교회가 세속 정부에 대해서 , 우월한 정신적 권위를 가지고, 세속 법정을 선도하거나, 형성 시키거나, 법 이념을 제시한 역사가 있었다. 그리고 서양 법의 세계에는 그러한 역사가 남아 있다. 이것은 동 아시아 법 문화의 역사와 대비되는 것이다.
Abstract
I was trying to look the old civilization in world history perspective of the Western tradition law on the issue of "separation of church and state" in the United States. The church in the history of the separation of church and state in the Western after "the theory of two swords" has a superior spiritual authority leading a secular court. This is in contrast to the history of East Asian Legal Culture.
