Abstract

In this paper, we examined the problems caused by the establishment of the Prohibition on Sexual Orientation and the provision of Gender Equality. As a legal problem of the prohibition of sexually oriented discrimination, homosexuality is an ethically controversial reason that there is a fair discrimination as a value-dependent reason. Unfair discrimination against homosexuals by distinguishing between actors and acts should be prohibited, but sound criticism of homosexuality itself should be allowed. Also, homosexuality lacking morality and universality can not be a human rights or a prohibition against discrimination. He mentioned the cases of foreign countries where the Anti-Discrimination Act was enforced and described the problems that arise when the laws are enacted. A detailed objection was made to the claim that sexual orientation is a global trend. To describe the problems associated with the establishment of the gender equality clause, we first examined the meaning of gender in gender equality. Gender equality is a concept that includes equality between various gender identities, that is, prohibition of discrimination against sexual orientation and gender identity, using the Korea Research Institute of Law, Wikipedia, Constitutional Advisory Committee reports, and the Public Law on Women's Development Act. Described. It described problems in the West in implementing gender equality policies and argued against claims that gender equality and gender equality are the same. The amendment to homosexuality and same-sex marriage was attempted by the National Assembly Constitution, but it is necessary to prepare a scholarly argument against the claim to homosexuality and same-sex marriage, since experts with such claims are still active.
