불법시위의 근절대책에 관한 연구

Abstract

Freedom of assembly and demonstration is a barometer of democracy. While Korea pursued to achieve democratization, assembly and demonstration became radical, and many citizens sympathized with them. However, current demonstrations staged by various organizations arguing for various causes are different from those in the past in terms of environment. Violent demonstrations cause loss of property and inconveniences to the nation and citizens. For this reason, it is desirable to punish illegal protesters according to laws. If the police makes judgment or enforces laws in consideration of the characteristics of assemblies, it would encourage illegal protests. Accordingly, it is important to consistently protect peaceful assemblies and remove excessive clamp-down by the police while sternly punishing illegal demonstrations and reversing conflicts between the police and citizens. In the meanwhile, it is necessary to come up with creative methods that can improve assemblies and demonstrations and attract citizens'attention. If diversified systems implemented by the police are facilitated, laws on assembly and demonstration are reasonably revised and separate countermeasures are suggested in consideration of situations, peaceful and legal assembly culture will be settled.
