초록

금융산업은 정보의 공유라는 제4의 산업혁명을 겪고 있다. 이에 따라서 사이버보안의 확보가 절대적으로 필요한 반면 이러한 필요성은 개인정보의 침해개연성을 높이고 있다. 정보의 공유는 또한 이를 활용한 핀테크의 출현과 함께 지급결제서비스를 비롯한 다양한 ICT 융합산업의 출현을 가능하게 하는 반면 이 역시 개인정보의 침해개연성을 높이고 있다. 이러한 작금의 기술의 발전과 이에 따른 새로운 산업의 육성필요성은 금융산업에서의 사이버보안에 대한 규제틀의 변화를 요구하고 있다. 이 글의 목적은 사이버보안에 대한 미국에서의 접근방법 그리고 최근 EU에서의 개인정보보호 및 지급방법에 관한 규정을 우리의 그것을 비교하여 금융당국의 정책방향을 제시하고자 함에 있다. 사이버보안과 관련하여서는 금융당국이 사전적으로 사이버보안관련 기술적 사양까지 일일이 정하여 주는 방식에서 보다 개방된 그러나 투명한 보안성확보방법의 개발을 보안산업에 맡기고 금융당국은 보안성의 측정지표만을 제시하는 방식으로의 전환을 제안한다. 개인정보를 활용한 핀테크산업의 촉진을 위한 금융정책의 변화로서는 EU에서의 개인정보보호 규정(GDPR)과 지급서비스지침(PSD 2)를 참고하여 개인정보 이동성보장과 사업자의 개인금융정보에 대한 접근권을 인정하여 줄 것을 제안한다.

Abstract

Technical advances have had enormous impacts on finance industry in general. While cybersecurity of the finance industry has been more frequently and deeply threatened, new industries based on combination of information, communication and technology such as fintech have been emerging. At this juncture, the current regulatory framework on cybersecurity and finance industry is worth revisiting. This paper reviews the experience of the United States in formating the cybersecury policy and the current legal regulations of the cybersecurity in Korea. Suggestions to the financial market regulator are: government support to private cybersecurity businesses; public disclosure of cybersecurity governance; immunity on information sharing; and periodic reports to the National Assembly on monitoring activities. Relating to fintech-based payment services, this paper visits the major points of the GDPR and PSD 2, Based on such endeavor, suggestions to the financial market regulator are: personal data portability requirements; and customer’s right to request the account holders such as banks share financial information with payment services providers.
