이 연구는 Freddolino, Moxley, & Hyduk(2004)가 제안한 ‘다중옹호모델(Differential Model of Advocacy)’에 따라 우리나라 권익옹호 사업의 성격을 유형화한 것이다. 이를 위해 현재 우리나라에서 권익옹호 사업으로 구분되고 있는 6개 사업을 분석의 대상으로 하였고, 사업들의 관련 규정, 업무 지침서 등을 확인하여 각 사업에서 진행하고 있는 권익옹호 사업의 성격을 분석하였다. 분석결과 분석대상인 6개 사업은 다중옹호모델에 따른 4가지 유형에 고루 속해 있는 것으로 나타났다. 옹호인이 옹호 목적과 수단을 모두 통제하는 ‘최선의 이익 옹호’ 유형에는 발달장애인지원센터의 권리구제 사업과 장애인거주시설의 인권지킴이단 사업이 속했다. 옹호 목적은 옹호인이 통제하지만 옹호 수단은 이용자가 통제하는 ‘이용자 중심 옹호’ 유형에는 장애인권익옹호기관의 권익옹호 사업이 속했다. 옹호 목적은 이용자가 통제하지만 옹호 수단은 옹호인이 통제하는 ‘활성화 옹호’ 유형에는 공공후견지원 사업이 속했다. 그리고 옹호의 목적과 수단을 모두 이용자가 통제하는 ‘이용자 통제 옹호’ 유형에는 장애인자립생활센터의 권익옹호 사업과 장애인복지관의 시민옹호 사업이 속하였다. 이를 통해 현재 권익옹호 사업의 다양성을 확인할 수 있었고, 다중옹호모델의 유용성을 확인할 수 있었다. 또 이를 통해 현재의 제도화 방안이 가장 적절한 옹호 유형인지에 대해서 논의하고, 각 사업이 발전 방향을 제시했다.
Abstract
This study analyzed the types of Korean advocacy works according to the ‘Differential Model of Advocacy’ proposed by Freddolino, Moxley, and Hyduk(2004). To this end, six programs currently classified as advocacy work in Korea were analyzed, and the nature of the advocacy programs was analyzed by checking the related regulations and work guidelines of the programs. As a result of the analysis, it was found that the six programs belonged to the four types according to the Differential Model of Advocacy. The rights relief program of the National Center for Persons with Developmental Disabilities and the Human Rights Protector of residential facilities for the disabled belonged to the type of ‘best interest advocacy’ in which advocates control both the purpose and means of advocacy. The advocacy program of the National Advocacy Agency for Persons with Disabilities belonged to the ‘client-centered advocacy’ type, where the purpose of advocacy is controlled by the advocate but the advocacy means is controlled by the user. The public guardianship support program belonged to the ‘Enabling Advocacy’ type, in which the purpose of advocacy is controlled by the user but the advocacy means is controlled by the advocate. Also, in the ‘consumer-controlled advocacy’ type, where users control both the purpose and means of advocacy, the advocacy program of the Independent Living Center for disabled persons and the citizen advocacy program of the Welfare Center for the Disabled belonged. Through this, it was possible to confirm the diversity of the current advocacy program and to confirm the usefulness of the Differential Model of Advocacy. In addition, through this, we discussed whether the current institution is the most appropriate type of advocacy, and suggested the development direction for each proram.
