우리나라 외근경찰 물리력 사용 가이드라인 재정립에 따른 현장 대응력 강화 내실화 방안에 관한 연구: 경찰 물리력 행사의 기준과 방법에 관한 규칙 제정안을 중심으로

최근 경찰위원회는 경찰청이 마련한 “경찰 물리력 행사의 기준과 방법에 관한 규칙 제정안”을 심의, 의결함으로써 2019년 11월경부터 우리나라 경찰 역사상 최초의 종합적인 경찰 물리력 사용 가이드라인이 시행될 예정이다. 이번 경찰 물리력 행사 기준에는 객관적 합리성의 원칙, 대상자 행위와 물리력 간 상응의 원칙, 위해감소노력 우선의 원칙 등 경찰 물리력 사용 3대 원칙과 대상자의 저항 정도에 따라 사용할 수 있는 경찰 물리력의 종류 및 방법을 설정한 “경찰 물리력 행사 연속체”도 국내 최초로 도입되었다. 새로운 경찰 물리력 행사 기준의 제정은 일선 경찰관의 보다 합리적인 물리력 사용으로 이어질 수 있을 것으로 기대된다. 그러나 경찰 물릭력 행사 기준에 포함된 경찰 물리력 사용 3대 원칙과 경찰 물리력 행사 연속체가 제 기능을 발휘하기 위해서는 휴대무기 체계 개편, 경찰 물리력 사용 교육 훈련제도 개편 등의 후속 조치가 반드시 선행되어야 한다. 이 연구에서는 이번 경찰 물리력 행사 기준 시행에 있어 반드시 선행되어야 하는 외근경찰 휴대무기 체계 개편, 종합 물리력 사용 훈련제도 완비, 종합 물리력 사용 훈련 교관 양성, 종합 물리력 사용 능력 평가제도 마련, 경찰 물리력 사용 적절성 심사 체계 마련 등 다섯 가지 후속 조치를 제안하였다.
Abstract
Recently, the Korean National Police Commission reviewed and approved of the new police use of force guideline in the Korean National Police, the first comprehensive police force regulation, which will be effective on November 2019. The new police use of force guideline contains three major principles, including “objective reasonableness standard”, “proportionality standard between citizens’ resistance and police force options”, and “de-escalation priority standard”. The police guideline also officially adopts “police use of force continuum” in the Korean National Police Agency, defining the five levels of citizen resistance and the corresponding police force options, respectively. It is expected that the new police use of force guideline will guide the proper and reasonable police use of force in the future. Nevertheless, much has to be preceded before the new police use of force guideline is fully effective. The current study suggests that the Korean Natioinal Police Agency should revise its police weapon-carrying system in order to make each individual officer carry all force options, including handgun, taser, OC spray, and baton which appear on the police use of force continuum. Furthermore, the present study also suggests that the Korean National Police Agency should adopt a new police use of force training and evaluation system that will test officers’ ability to use all the force options available in the line of duty. Finally, the current study highlights the importance of police use of force review boards.
