본 연구는 두 기업의 특허 경쟁(patent races)을 분석한다. 각 기업은 특허 기술을 개발하면서, 특허 출원도 진행해야 한다. 본 연구의 목적은 기업이 특허 전문대리인을 통해 특허 출원을 진행할 때, ‘기업의 기대보수’와 ‘지대소진(사회적 자원낭비)’의 변화를 분석하는 것이다. 이를 위해 본 연구는 두 종류의 2단계-특허 경쟁을 고려한다: 주도자 게임과 경기자 게임. 주도자 게임의 제1단계에서 기업은 기술개발 그리고 제2단계에서 특허 출원을 진행한다. 경기자 게임의 제1단계에서 기업은 기술개발과 성공보수계약을 진행하고 제2단계에서 기업의 대리인은 특허 출원을 진행한다. 두 게임으로부터 각각의 부분게임완전균형을 얻고, 균형 결과를 비교한다. 주요 결과는 다음과 같다. 첫째, 기업은 대리인을 고용함으로써 특허 개발비용을 줄이고 자신의 기대보수를 높인다. 둘째, 대리인을 고용함으로써 지대소진이 줄어든다.
Abstract
This study analyzes patent races between two firms, which must develop and file for patents while competing against each other. The study investigates the effects of using patent attorneys to file for patent on two firms’ expected payoffs and social resource waste. the research considers two types of two-stage patent races: a principal game and a player game. in the principal game, a firm develops technology in the first stage and files patents in the second stage. In the player game, a firm conducts technology development and contingent fee contract in the first stage and hires an attorney to file patents in the second stage. The study compares equilibrium outcomes for these two games and identifies that hiring an attorney reduces the cost of patent development and increases expected payoffs for firms while also decreasing social resource costs.
