숙의제도 및 공론조사의 숙의성과 참여성 고찰: 제주녹지국제병원공론조사 사례를 중심으로

숙의민주주의는 대의민주주의의 실천적 처방이자 참여민주주의 이론의 제도적 모델이다. 본고의 궁극적인 목적은 숙의민주주의의 이론적 함의를 고려한 숙의제도 및 공론조사의 방향성을 제언하는 것이다. 이를 위해 우선 숙의민주주의의 이론적 함의를 논의하고 네 가지 주요 비판에 대한 정당성을 검토하였다. 논의 결과를 토대로 피시킨의 공론조사를 검토하고 이상적 공론조사 모델을 제시하였다. 그 후 이론적 논의 결과를 최근 실행되었던 제주 녹지국제병원 공론조사 사례에 대입해 숙의성과 참여성에 대한 몇 가지 실천적 문제를 검토하였다. 검토 결과, 공론조사가 숙의민주주의 실현에 대해 실천적 참여성을 확보하기 위해서는 권고안을 청원의 형태로 바꾸거나 법적⋅제도적 기반이 마련되어야 한다. 실천적 문제를 논의한 결과, 숙의절차를 통해 도출된 시민사회의 합의가 담론윤리적 가치를 인정받기 위해서는 제도적 차원에서 실천적 숙의론에 입각해 대표성 문제를 해결하고 정당성을 보완해야한다. 문화적 차원에서 숙의민주주의의 실현을 위해서는 대의제의 오랜 정치-문화적 통념을 극복하려는 자발적인 노력이 필요하다.
Abstract
Deliberative democracy is a practical prescription for representative democracy and an institutional model of participatory democracy theory. The main purpose of this study is to propose the design of systems and deliberative poll that take into account the theoretical implication of deliberative democracy. For this purpose, I discussed the theoretical implications of deliberative democracy and reviewed the legitimacy of the four main criticisms. Then I reviewed the deliberative poll of Fishkin based on the results of the discussion and presented an ideal deliberative poll model. Next, based on the results, I analyzed the recent cases of deliberative poll of Jeju Greenland International Medical Center and reviewed some practical questions about maturity and participation. As a result of the theoretical discussion, the recommendations should be changed to the form of a petition or a legal and institutional basis should be established in order for the deliberative poll to secure participation. As a result of reviewing practical problems, the question of representation at the institutional level must be resolved and supplemented with legal and institutional legitimacy in order for social consensus to be recognized for its discourse ethics value. To realize deliberative democracy on a cultural level, voluntary efforts should be made to overcome the old political-cultural perception of representative democracy.
