Abstract

This paper attempts to clarify the long-debated issue of what it means by ‘leveraging of market power’ in media and telecommunications and how we identify its anti-competitiveness. It is unclear whether the term has an independent meaning in competition law or just a collection of well-defined anti-competitive practices such as tying and refusal to deals. As a result, the term has often been used rather vaguely and even abusively by interest groups to promote their agenda. Observing that the controversy over ‘monopoly leveraging theory’ in antitrust law bears close similarities to this issue, this paper first reviews the related legal cases and discussions from the US, EC, and Korea. In the US, monopoly leveraging was once accepted as the ground for Sherman law violation but no longer. The court requires specific causal links between anti-competitive behaviors in tying market and rising monopoly power in tied market. By contrast, EC is less stringent in invoking the theory but only under very ‘special circumstances.’ Korean courts, while not denying possibilities, in effect reject the theory by requiring very strict conditions based on the supreme court’s POSCO (2007) rulings. As a result, the paper claims that the leveraging of market power does not provide any independent ground for regulation, without resorting to specific types of anti-competitive behaviors such as tying and bundled discounts. Next, the paper summarizes the situations that would occur through bundle sales and see in which cases the anti-competitiveness concerns arise. The main focus here is the causes of market share rises in tied market, but this may occur either because of redistribution of competitiveness across markets, convergence of two markets, or pricing strategies such as penetration or predation. Among these situations, it is shown that the only case to be worried as anti-competitive is the predatory pricing. Lastly, the paper focuses on bundled discounts and review the various tests that have been suggested to evaluate their anti-competitiveness, drawing implications for the most prudent approach. If bundles compete with the same set of components, the simple profit sacrifice test would be enough, whereas the discount attribution test and Elhauge (2009) test may be used as the safe harbour for the bundles with different components.
