Abstract
Recently, an amendment of three data related law has been announced, which is expected to stimulate the data economy. In particular, the introduction of right to data portability, a system intended to drive active utilization of data, is expected to allow individuals to exercise more control as their own information entity. However, the right to data portability in Use and Protection of the Credit Information Act §33 does not regards all the information provided to data controllers in its scope and is limited to private credit information portability. Therefore, it may be difficult to regulate other high-tech industries if a market dominant operator commits an abuse of status or unfair trade practices in relation to user data. In this respect, preparations are needed to regulate anti-competitive behavior by market-dominating operators in data-related markets. Accordingly, the essential facility theory, which is the basis for determining the illegality of refusal to deal, is to be reviewed as a way to solve the problem of data monopoly by market dominant operators and to revitalize the data economy. In order to apply the essential facility theory as the basis for determining the illegality of a market dominant operator's refusal to deal in a data-related market, it is first necessary to discuss whether data can be regarded as essential facilities, which are essential inputs to the performance of the business. Until now, the application of the essential facility theory has been criticized for hindering incentives for innovation by the pioneer and violating the principle of private autonomy pursued by the market economy system. Such criticism will still be valid when applying the essential facility theory as a basis for determining illegality in a refusal to deal of the data. Therefore, this paper would like to review the applicability of essential facility theory based on the illegality of data-related market dominant operators, focusing on the application of essential facility theory in the U.S., where the principle of private autonomy is applied more strongly in Korea under the competition law.
