온라인 플랫폼 자율규제에 관한 시론 - 맥락적 접근을 중심으로

2022년 5월 새 정부가 들어서면서 지난 해까지 추진되던 규제 입법 대신 ‘자율규제’로 정책 방향이 급선회하였다. 이를 통해 최소한 플랫폼 규제에 대해 엄격한 법적 규제를 채택하기 전에 더 숙고할 기회와 시간이 주어진 셈이다. 그렇지만 자율규제는 법적 규제와는 다른 측면에서, 법적 규제 못지않게 난이도가 높은 과제이다. 강제 없이, 다양한 주체들의 자발적, 적극적 참여를 이끌어 내고 상충되는 이해관계들을 조율하기 위해서는 규범에 대한 사회적 공감대와 각 주체들 간의 신뢰가 필요하다. 또한 우리 사회에 뿌리 깊은 자율규제의 전통이나 정부와 사회 각 집단들 상호간에 신뢰의 문화가 부족하다면, 자율규제의 계기에 이를 배양하기 위해서는 각 주체들의 목표와 행위의 동기들에 대한 훨씬 더 많은 이해와 노력이 필요하다. 따라서 플랫폼 일반, 규제이슈 일반에 대해 적용되는 단일 모델의 자율규제는 존재하지 않고, 개별 맥락별 접근이 필요하며, 법사회학 등 학제간 접근이 필요하다. 자율규제는 법적 과정일 뿐 아니라 정치과정으로서의 특징을 갖는다. 우리나라와 같은 민주주의 국가에서 규제는 정치적 압력에 대한 반응으로 나타나므로 이에 법적 합리성을 기하기 위한 노력이 필요하다. 또한 규제 이슈가 경제적 규제인지 사회적 규제인지에 따라서도 적합한 자율규제의 양태가 달라질 수 있다. 현재의 플랫폼 규제는 플랫폼이 산업 전반에 가져온 파괴적 혁신의 영향으로부터 보호받기를 원하는 자영업자 등의 요청에 대한 반응이다. 그러나 플랫폼은 규칙이 지배하는 하나의 공간을 만드는 역할을 한다. 따라서 플랫폼의 특징과 잠재적 가능성에 맞는 자율규제를 시도할 필요가 있다.
Abstract
As soon as the new government came in May, 2022, the platform regulation policy of Korean government has changed abruptly from new regulatory legislation to self-regulation. At least, we can afford more time and opportunities to deliberate how to solve the issues of platform regulation. Self-regulation is no less difficult than legal regulation. It requires social agreement toward ‘norm’ and trust to draw voluntary and active participation of various interested parties without binding force and enforcement power. Because we lack tradition and culture of self-regulation we should learn and accumulate trusts in any kind of experience of self-regulation. Therefore, there is no single right model of self-regulation. It needs to approach contextually to specific issue of regulation in the specific regulatory environment. It also requires interdisciplinary research because we deal with factual world, not with nomos. In democratic nation, regulation is a response to political pressure. We need to bring legal rationality to make regulation reasonable. Depending on the character of regulatory issues, social or economic etc. the plausibility and the appropriate form of self-regulation can be different. For example, the recent issue of platform regulation which had been responded from Congress as multiple legislative bills can be defined as a call for balancing negotiating power between platform industry and small sellers. However, another context of ‘platform’ is that it is forming a space. The special character and possibility of ‘platform’ should be considered when we make a proposal about self-regulation approach.
