Abstract

It is remarkable that recent studies on William Shakespeare’s drama urge would-be lawyers to pursue an in-depth understanding of the law. This article aims to provide lawyers with a thought-provoking interpretation of Shakespeare’s Measure for Measure (hereafter “the Work”) from the perspective of the rule of law. An era of rule of man came to an end long time ago. Yet most people do not seem to fully realize the notion of the rule of law and the ways to maintain or protect it. The rule of law is not a natural phenomenon, but a matter of care and careful concern. This article calls attention to the fundamental question of the rule of law partly as an attempt to explore the ways in which law and justice are questioned and constructed in literature as follows. First, this article explicates English marriage law along with the political and historical backgrounds of the Work during the reign of James I. Second, L. Fuller’s ideas of ‘Morality of Law’ inspire us to examine the compatibility between monarchy and the rule of law. Furthermore, this article argues that Montaigne’s thoughts on law make a decisive contribution to the democratic construction of law. Lastly, it is compelling to note that Judith Shklar’s notion of ‘ordinary vices’ alerts lawyers that the rule of law could be well established with the exercising of self-vigilance against vicious personality including acts of cruelty, hypocrisy and a fallacy of snobbery that lawyers themselves might commit as opposed to what they are expected to do.
