가짜뉴스의 규제에 관한 비교법적 연구 - 미국의 논의를 중심으로 -

초록

오늘날 각국은 가짜뉴스의 폐해를 인식하고, 이에 대처할 수 있는 여러 법적인 방안들을 강구하고 있다. 이 글은 먼저 가짜뉴스에 관한 헌법적 논의가 일게 된 배경을 살피고, 가짜뉴스의 개념요소를 검토하였다. 그리고 가짜뉴스 논란의 진원지이며 표현의 자유에 관한 다양한 법리를 발전시켜온 미국에서, 가짜뉴스에 관한 논의가 어떻게 전개되고 있는지를 살피고 이를 평가하였다. 미국에서는 가짜뉴스를 표현의 자유의 보호영역에서 배제하자는 주장, 가짜뉴스 규제입법의 위헌성 심사기준을 완화하자는 제안, 온라인서비스제공자의 법적 책임을 강화하자는 견해 등이 개진되었다. 가짜뉴스로 인하여 사상의 자유시장이 실패할 가능성을 경고한 연구, 표현의 자유에 관한 내용중립적인 규제방안을 제시한 연구도 있다. 이러한 논의는 우리에게 적잖은 시사점을 줄 수 있다. 그러나 미국과 우리나라에서 표현의 자유가 가지는 위상이 다르며, 가짜뉴스에 적용될 수 있는 현행법 규정이나 가짜뉴스의 실태에 적잖은 차이가 있음을 감안해야 한다. 예컨대 일반적 법률유보조항을 둔 우리나라에서는 가짜뉴스를 표현의 자유의 보호영역에서 배제해야 할 필요가 미국에서보다 절실하지 않다. 또한 온라인서비스제공자에게 적용될 수 있는 다양한 현행법 규정이나 최근 발의된 법률안의 내용에 비추어볼 때, 온라인서비스제공자를 과도하게 규제하지 않도록 제도를 설계하는 슬기가 필요하다. 미국을 비롯한 주요 국가들에서의 논의를 종합적⋅비판적으로 검토하면서 우리의 현실에 부합하는 가짜뉴스 대처방안이 강구될 수 있기를 기대한다.

Abstract

Today, every country recognizes the harmful effect of fake news and seeks several legal options for coping with that. This study first investigated the background on which the constitutional discussion on fake news started and reviewed conceptional elements of fake news. In addition, this study examined and evaluated how discussions on fake news were developed in the United States, the starting place of disputes over fake news, where various legal principles on the freedom of expression have been developed. In the U.S., an argument that fake news should be excluded from the scope of the protection of freedom of expression, a proposal for the relaxation of standard of constitutional review over legal restrictions on fake news, and a proposal for the strengthening of online service providers’ legal liability have been set forth. There are studies that warned the possibility of failure in the marketplace of ideas due to fake news and that presented content-neutral restrictions on the freedom of expression. These discussions can give us more than a few implications. However, it is necessary to take into account that the freedom of expression has a different status in the U.S. and the Republic of Korea and that there is more than a little difference between provisions in the present law that can be applied to fake news and the realities of fake news. For instance, in Korea, having provisions for general statutory reservation, it is less urgently necessary to exclude fake news from the scope of protection of the freedom of expression than in the U.S. In addition, judging from various restrictions of the present laws that can be applied to online service providers or the contents of the legislative bills recently proposed, it is necessary to have wisdom to design the system so that it does not excessively regulate online service providers. Hopefully, it is expected that a plan for coping with fake news, corresponding to realities in Korea, can be devised, critically reviewing discussions in the major countries.
