전국 로스쿨 학생의 지적장애인에 대한 다차원적 태도 분석: 로스쿨의 법조인 양성교육에 대한 함의

본 연구는 예비 법조인인 로스쿨 학생의 지적장애인에 대한 다차원적 태도 및 3가지(인지적, 정의적, 행동적) 하위태도의 수준과 양상 및 배경변인과의 관계에 대한 분석 결과를 국내에서 최초로 제시하였다. 본 연구진은 예비 법조인과 법조인의 ‘지적장애인’에 대한 양질의 법률서비스를 위해 태도의 중요성 문제를 제기하며 긍정적 태도 육성에 관심과 교육 기회 증진을 촉구하며 로스쿨의 법조인 양성교육에 대한 함의를 제공하였다. 본 연구도구는 「전국 로스쿨 학생의 지적장애인에 대한 다차원적 태도 조사」라는 무기명 질문지이며, 태도 척도는 2018년에 김유경과 박승희가 타당화한 도구인 「한국판 지적장애인에 대한 다차원적 태도 척도(K-ATTID)」이다. 전국 로스쿨에서 무작위로 선정된 11개 로스쿨에서 표집된 총 541명 예비 법조인의 응답 자료가 연구 문제에 따라 기술통계 및 추리통계로 분석되었다. 연구 결과 전국 11개 로스쿨의 541명 예비 법조인의 지적장애인에 대한 다차원적 태도의 평균은 5점 라이커트 척도에서 3.53으로 3점 ‘보통’ 수준보다 약간 높게 나타났으며 3가지 하위태도 수준은 인지적, 행동적, 정의적 태도 순으로 높게 나타났다. 지적장애인의 지적기능성 수준에 따른 태도 차이는 경도 지적장애인에 대한 태도가 중도 지적장애인에 대한 태도보다 유의하게 높게 나타났다. 응답자의 배경변인 중 성별, 장애학생과의 통합수업 경험, 장애인 대상 봉사활동 기간, 알고 있는 지적장애인의 수가 예비 법조인의 지적장애인에 대한 태도에 유의한 영향을 준 것으로 나타났다. 끝으로 본 연구의 의의와 한국 로스쿨 운영 10년 차를 맞은 현시점에서 본 연구 결과가 로스쿨의 법조인 양성교육에 지니는 함의와 시사점을 제공하였다.
Abstract
The purpose of this study was to examine Korean law school students’ attitudes toward persons with intellectual disabilities(ID) and to generate some suggestions for law school education. The Korean Version of the Attitudes Toward Intellectual Disability Questionnaire(K-ATTID) developed by Kim & Park(2018) was used to measure the multidimentional (cognitive, affective, behavioral) attitudes toward persons with ID of 541 students randomly selected from eleven law schools nationwide. The students responded to the 36 items of K-ATTID by 5 point likert scale(5: very true to 1: not at all). The higher the score on the items of K-ATTID, the more positive was the attitudes toward persons with ID. The mean of 541 students’ multidementional attitudes was 3.53, which could be interpreted as not positive but medium level of attitudes. The respondents showed more negative attitude towards persons with severe ID compared to persons with mild ID. The respondents’ background variables including gender, degree of inclusive classes in their earlier schooling, lengths of volunteer works, and number of acquaintance with ID were related with the level of attitudes toward persons with ID. This study is the first study in Korea that examines the law school students’ attitudes toward persons with ID and brings out the issue that enhancing lawyers’ positive attitudes toward persons with ID is critical for providing high-quality legal services for persons with ID. This study can promote the need for reexamination of implementation of the current law school curriculum in order to nurture the positive attitudes toward persons with disabilities of law school students and lawyers and to provide high quality legal services for individuals with intellectual disabilities.
