비정규노동정책과정의 동태성 연구: 옹호연합모형(Advocacy Coaliation Framework)과 복합흐름(Multiple Streams)이론의 적용을 통한 조직간 역학관계 분석

이 연구는 비정규노동법 제정과정을 옹호연합(Advocacy Coalition Framework)과 복합흐름(Mutiple Streams)의 이론을 적용해, 노･사･정 상호작용에 주목하면서 비정규직 노동정책의 동태성을 분석했다. 복합흐름모형에서는 정책변동의 촉발기제를 분명히 설명해내는 정책창(window for policy change) 개념을, 옹호연합이론에서는 노･사 양 정책대상집단 본질적인의 핵심가치를 유지･확장하기 위해 벌이는 정잭조직간 전략･학습을 통한 정책대결(policy battle) 개념에 방점을 두고 살펴 보았다. 2회에 걸친 입법화 논의로 비정규노동정책은 설명할 수 있다. 1997 경제의기 극복과정에서 불거진 비정규노동문제 해소를 위한 2000년-2001년 사이 노사정위원회 ‘비정규대책특위’에서의 논의와, 2003-2006년 사이 정책조직의 반대를 무릅쓰고 정부안을 국회의장 지권상정으로 2006년 비정규노동법 제정이 그것이다. 첫 번째 시도 입법화 불발은 부집행(non-implementation)에 따른 정책실패(policy failure)로 풀이되며, 두 번째 시도는 입법화의 성공으로 일단 집행가능에 성공한 정책대결의 잠정적 종료에 불과한 것으로 해석된다. 정책대결의 잠정적 종료라 해석하는 이유는 2006이후 비정규노동법은 정책옹호(대결)조직 간, 즉 노동계 경영계 모두로부터 저항에 직면해 있기 때문이다. 이런 저항은 다중흐름에서 상정하는 바와 같이 ‘주의집중사건’(focusing events)과 결합하면서 정책의 창이 열리는 순간 향후 언제든지 또 다시 정책대결(policy battle)은 재점화 될 것이다. 비정규노동정책의 동태성은 바로 이점에 있다.
Abstract
By applying the theories of advocacy coalition framework and multiple streams, the study is to dynamic nature of non-regular workers’ labor policy. In crafting the labor policy there were two times of legislation attempts. The first, which occurred between 2000 and 2001, was one led by the special committee for non-regular workers. This attempt failed to become law regulating industrial relations for them, and the policy failure can be explained by a phenomenon of non-implementation. However the second attempt, which took place between 2003 and 2006, was successful in making law in spite of strong opposition from labor and management. This successful legislation is called as ‘tentative policy termination’ in this study. The reason for calling such is that it is highly likely for a policy battle to resume between such conflicting organizations as labor and management as long as the emergence of focusing events can result in opening ‘policy window for change’. This nature may render the policy making process dynamic.
