『마누법전』에 규정된 죄와 벌의 근거 및 성격

『마누법전』은 베다의 신화와 제식주의적 세계관에 입각하여 구축된 고대 인도인들의 삶의 전형이다. 『마누법전』은 淨과 不淨 혹은 法과 非法이라는 근본적인 틀에 의거하여 여러 계급집단들이 인생의 각 단계에서 어떤 목적과 가치를 어떻게 추구해야 하는지 그 기준과 방향을 제시하고 있다. 본고 제Ⅱ장에서는 다양한 삶의 규범과 생활양식들을 규정하고 있는 『마누법전』이 성립된 배경을 추적해 보고, 이 법전을 이루고 있는 중심 개념인 種姓(varṇa)과 인생의 4가지 목적(puruṣārtha), 그리고 인간이 걸어가야 할 단계(āśrama) 등에 대해 고찰해 보았다. 이어서 제Ⅲ장에서는 『마누법전』에서 규정한 규범들에 대한 위반 행위라고 할 수 있는 죄와 그에 대한 처벌 규정에 대해 고찰하였다. 마누법전에 거론되고 있는 죄의 종류는 매우 다양하지만, 필자는 『마누법전』에서 죄로 규정되어 있는 다양한 행위들의 유형을 분석하고 그 특징 및 문제점 등을 도출해 보았다. 칸트가 행위의 죄악성에서 처벌의 근거를 찾았고, 헤겔이 범죄의 자기모순성에서 형벌의 근거를 찾았다면, 『마누법전』은 제식주의에 기초한 브라만 중심의 세계관에서 비롯된 淨과 不淨 혹은 正法과 非法이라는 구분에 입각하여 형벌의 근거를 찾았다. 필자는 『마누법전』에 규정된 형벌 및 속죄방법 등이 브라만에게 특히 유리하게 되어 있어 공평성에 문제가 있을 뿐만 아니라, 量刑 및 속죄규정에 있어서도 비현실적으로 가혹한 측면이 있다는 점에 주목하고, 이 문제를 죄의식과 연관지어 생각해 본 결과, 『마누법전』이 의거하고 있는 ‘다르마’의 합리성 및 공정성에 문제가 있음을 확인할 수 있었다. 죄에 대한 형벌이 그 이상적인 목적 및 취지를 제대로 실현하기 위해서는 죄업을 지은 자의 죄의식이 전제되어야 하며, 죄와 형벌 사이에 공정성과 적정성이 확보되어야 한다. 그러나 『마누법전』에 규정된 죄와 형벌은 죄의식과 그에 수반하는 반성을 배제함으로써 ‘억압을 정당화하는 장치’로서의 색채를 강하게 띠게 되었다고 생각된다.
Abstract
Manu-Smṛti is a typical model of ancient Indian's life based on Vedic myth and ritualism. Manu-Smṛti presents standards of human purposes in India that each varṇa should pursue in each stage of life on the basis of śuddha and aśuddha or dharma and adharma. Especially dharma was applied to individual life and the way of life as ethics or the criterion of the ethics including truth, moral and religious duty, custom, endurance, forgiveness, restraint, cleanness(śuddha) etc. The rights of ownership, and any other rights endorsed by dharma were protected by the provision of penalties or sanction. In chapter Ⅱ, I studied on the background of the formation of Manu-Smṛti, and the concepts of varṇa, puruṣārtha and āśrama. In chapter Ⅲ, I studied on sins and regulations on punishment in Manu-Smṛti. There are many kinds of sins in Manu-Smṛti. Therefore I analyzed the types of sins, and inquired into the characteristics and problems of various sins. Manu-Smṛti considered aśuddha or adharma as the bases of punishment, whereas Immanuel Kant immorality, and Georg Wilhelm Friedrich Hegel self-contradiction. I payed attention to the impartiality of punishment and unreasonable weighing of offense in Manu-Smṛti. Relating this problem to guilt, I confirmed that there are many problems with impartiality and rationality in the conception of dharma in Manu-Smṛti. It is because guilt of a criminal should be premised as well as impartility and reasonableness between sin and punishment for the realization of ideal purpose of punishment.
