본 연구는 에너지 산업의 환경변화에 따른 에너지 사업자간의 기업결합으로 발생되는 반경쟁적 유인 등을 살펴보고 이를 효율적으로 규제할 수 있는 방안을 제시하고자 한다. 에너지 부문에서 다양한 사업자가 등장하고 다양한 분야의 서비스가 제공됨에 따라 공급의 안정성과 위험회피를 위한 기업간의 결합이 발생하고 경쟁제한적인 시장구조는 이러한 결합이 전략적으로 일어날 유인을 제공하였다. 특히 에너지 기업들의 수직적 결합에 따른 경쟁저해적인 배제유인은 상류기업의 하류부문 시장지배력, 수요 및 공급 탄력성, 그리고 정보의 비대칭 정도에 따라 발생될 소지가 크다. 이러한 잠재적 반경쟁적 유인을 사전에 방지하기 위한 효율적 방안으로서 접속차별이나 규제회피 요인을 반영하기 위한 기준과 결합심사 시 효율성 증대 효과를 현실화하며 또한 규제체계도 단일화된 전문규제기관이 기능별 규제를 할 필요가 있음을 제시하였다.
Abstract
This paper tries to investigate incentives for anticompetitive behavior by vertical integrated firms in energy sectors and provide ways to implement effective regulation against them. Non-Competitive market structure can lead the merger incentives among energy companies in different energy sectors with the strategical purpose. As incentives for anticompetitive behaviors by vertical integrated firms, market foreclosure is more likely to occur, based on degree of upstream's market dominance in downstream sector, elasticity of product's demand and supply and Asymmetry information. This paper suggests that the effective regulation against such potential anticompetitive behaviors by integrated energy companies can be achieved through set-up the regulatory standards to assess potential anticompetitive elements like discriminating access and evasion of regulation. Also, this study suggests that it is necessary to build a single energy specialized regulation body with regulation by functions rather than by energy sources as a new regulatory framework.
