유럽의 가정폭력범죄 대응정책에 관한 검토

가정폭력은 국가의 개입을 자제해 오다가 가정폭력에 대한 국가개입의 필요성과 그에 대한 사회적 관심이 커지면서, 1997년 12월 ‘가정폭력범죄의처벌등에관한특례법’의 제정을 통해 국가에서 공적으로 개입하게 되었다. 그러나 동 법률의 시행에도 불구하고 여전히 가정폭력이 발생하는 등 가정폭력특례법이 가정폭력범죄에 대한 적절한 대응이 되지 못한다는 비판과 함께 그에 대해 개선의 노력이 이어져 왔다. 그럼에도 가정폭력특례법이 가정폭력범죄방지를 위해 실효성을 거두고 있는지, 특히 가정폭력이 살인 등 중범죄로 이어지는 위험성을 어느 정도 반영하고 있는지는 의문이다. 독일 등 유럽 국가들에서 가정폭력에 대한 대응을 여성피해자의 보호에서 출발하고 있고, 특히 유럽에서 가정폭력을 통한 사망사건이 많아지면서 그에 대한 대응정책에 관심이 모아지고 있는 것을 발견할 수 있다. 독일·스위스·오스트리아의 가정폭력에 대한 대응정책의 공통점은 피해자보호에 최우선을 두고 있다는 것이다. 특히 가정폭력이 살인과 같은 중범죄로 발전하는 것을 차단하기 위하여 민사법적 영역에서 적극적으로 개입하고 있는 모습을 발견할 수 있다. 또 최근 독일과 스위스에서 법원이 가정폭력으로 접근금지명령을 준수사항으로 부과하면서 그 이행여부를 감독하기 위해 전자감독을 시행한 것은 우리에게 시사하는 바가 있다.
Abstract
This paper analyzes the current criminal politick and practice on domestic violence in europe. Under the current criminal justice system the victims does not have effective measures for their protection against repeated violence. And the judicial dispositions on the offenders cannot contribute to deter the danger of repeated violence. Our measures to cope with domestic violence mostly focus on criminal law aspects. Amendment is needed, which refers to “Gewaltschutzgesetz” of Germany which is a special rule for civil disposition with regards to domestic violence. “Gewaltschutzgesetz” which Germany introduced in 2002 has characteristic as comprehensive law covering civil law·criminal law and other areas although it addresses mainly violence crimes. In this law, major civil disposition against a domestic violence perpetrator is depriving him/her of the right to residence and ordering him/her to leave it, which has been very effective in preventing domestic violence. Our current Act on the Crimes of Domestic Violence also adopts a victim protection order, one of civil dispositions, but it fails to do a main function. It is a mere subsidiary disposition in the whole legal framework. Thus, civil measures based on essential characteristic of domestic violence crimes are needed as effective measures against domestic violence crimes. The Act on the Crimes of Domestic Violence needs to be combined with the Act on the Prevention of Domestic Violence and Protection, etc. of Victims with a civil protection order as the main content.
