우리는 대중매체를 통해 각계각층 공직자의 위장전입, 병역면제, 불법증여, 부동산 투기, 세금탈루와 같은 개인 비리와 함께, 직무와 직접 관련된 뇌물수수, 공금횡령, 권력남용, 인사비리, 정보유출 등에 관한 보도를 접하곤 한다. 이러한 비리, 부정, 부패 행위의 주체에는 우리 사회의 상류층에 속하는 정치인, 고위 행정관료, 일반 공직자, 기업인 등이 포함되기에, 국민들은 더 큰 충격과 실망감을 느끼게 된다. 국제투명기구(TI)의 발표에 의하면, 우리나라의 2014년도 부패인식지수(CPI) 혹은 국제투명성지수는, 175개국 중 43위를 차지하고, 경제협력개발기구(OECD)에 가입한 34개국 중에서 27위에 머물러 있다. 우리나라는 1995년부터 조사가 시작된 이후 지금까지, 매년 40-50위 사이에서 오락가락 하면서, 하위권에 머물고 있다. 그렇다면, 공직자의 부정과 부패를 해소하고, 바람직한 공직자상을 정립하기 위해 어떻게 접근할 것인가? 이에 대한 원인 분석과 해결책 모색에 관한 지금까지의 연구들은 대체로 ‘법’이나 ‘행정’ 쪽에서 시도되었다. 이에 반해, 본 연구에서는 공직자가 갖추어야 할 바람직한 윤리적 원리와 자질 문제를, 윤리학에 의거해서 접근하였다. 구체적으로 1) 직업윤리 시각에서 공직윤리의 성격을 어떻게 볼 것인지, 2) 우리나라 공직윤리의 실상이 어느 수준인지를 알아보고, 이에 대한 대응 방안이나 과제를 윤리적 관점에서 도출하였다. 3) 그리고 바람직한 공직자상을 정립하기 위해, 우리나라 공직자들에게 요구되는 윤리적 원리와 자질들을, 세 가지 윤리학(의무윤리학, 덕윤리학, 책임윤리학)의 관점에서 도출하고, 이를 공직자에게 적용하였다.
Abstract
Almost everyday, we are exposure to news report about personal irregularities like as false resident registration, exemption from military service, illegal transfer of wealth, speculative investment in real state, tax evasion, and job-related illegality and corruption like as bribery, peculation, abuse of power, celebrity scandals, information leak from mass medias. Because politicians, high-ranking officials, businessmen besides public officials are belong to these activity subjects, people feel more huge shock and disappointment. According to Transparency International(TI), Korea's Corruption Perceptions Index(CPI) is ranked the 43rd among 175 countries. So far, the studies that resolve the illegality and corruption of public officials have depended on legal or administrative perspectives. The goal of my paper is to approach to the desirable ethical principles and qualification that public officials must have. The concrete contents as follows : 1) how can we define the public official ethics, 2) review the actual level of public officials' ethics in Korea, and present the ethical tasks to deal with these problems, 3) in order to establish the desirable public officials' image, draw the ethical principles and qualification from three ethical theories(duty ethics, virtue ethics, responsibility ethics), and apply these to public officials.
