21세기 지방자치의 현대적 경향 : 영국과 프랑스의 지방자치의 진화

초록

일반적으로 서구 민주주의 국가의 지방행정에 대한 대립된 두 가지 큰 흐름을 발견할 수 있는데, 그 하나는 분권화된 지방자치단체의 존재를 오랫동안 강화한 "자치정부(self-government)"의 영국적 전통에 기인하는 것이고, 다른 하나는 쟈꼬방주의(Jacobinisme)와 나폴레옹주의(Napoléonisme)에 각인된 프랑스적 도청체제(le système de préfecture)로 설명될 수 있는 지방분산(행정분권)이론(la théorie de la déconcentration)에 해당된다. 즉, 서유럽에서 서로 다른 두 가지 형식의 지방자치의 모습을 보였는데, 영국과 프랑스 모델이 그것이다. 이는 한국지방자치학계에서 주민자치와 단체자치로 명명하여 왔다. 그런데 이제 변화된 지방자치행정환경에 맞는 지방자치의 진화된 모습을 분석하여 새로운 지방자치의 경향을 제시하고자 한다. 이를 위해 역사적 배경, 중앙과 지방정부와의 관계, 지방정부와 주민과의 관계, 지방정부체제의 구조와 기능을 이론적 분석틀로 활용하여 양국의 지방자치의 상이점과 유사점을 밝히고자 하였다. 요컨대, 21세기 양국의 지방자치의 흐름은 지방정부개혁으로서의 공통으로 지방분권과 지방행정체제개편이라는 방식으로 나타났는데, 영국의 그것은 지방분권의 대세 속에서, 특히 지방권한을 대폭적으로 이양하여 지역의 다양성과 특수성을 존중한 정치적 분권과 주민투표에 의한 지방정부구성, 효율적인 행정업무 창출을 위한 중앙정부의 통제강화 등 지방분권과 중앙집권의 조화를 도모하려는 “하이브리드(혼합)지방자치(hybrid local autonomy)”의 모습을 보이는 반면 프랑스의 그것은 미테랑 정부이래 우파․좌파정부를 막론하고 계속해서 지방분권개혁을 주도해왔지만 결국 중앙집권적 틀에 지방분권화를 도모하려는 ‘순화된 자코방주의(Jacobinisme appriviosé)’와 나폴레옹주의에 따른 “하이브리드(혼합)지방자치(hybrid local autonomy)”로 볼 수 있을 것이다.

Abstract

Two major systems bring opposite solutions to the need for territorial administration experienced by Western democracies. The one, based on the British tradition of "self-government" has long since confirmed the existence of regional and local authorities. The other, attributed to the Jacobin and Napoleonic ideology, has led to the theory of devolution(deconcentration) and illustrated through the French prefectoral system. Two joint formulas can in fact be observed in Western Europe. We quickly evoke those practiced today Britain and France. The style and approach of the two local systems look very different : local government in Britain was to be called "autonomy of citizens(autonomie des citoyens)", whereas local government in France was to be called "community autonomy(autonomie des collectivités)" in Korea academic area(Korean Association for Local Government Studies). This comparative study tried to find a distinguishing mark between two countries by using the analytic framework - the historical background, the relation centre-local, the relation local-citizens, the structure of local government. A further purpose is to describe the trends of the local autonomy in the 21st century. This comparative study found following factors : evolution from contrasts to analogies, indeed, it has probably not been sufficiently recognised that the disparities, and even the contradictions, between the two local traditions have been greatly reduced by changes in social conditions, such as to produce in recent years an unusual degree of convergence between the British and French system of local government as the results of centralization and/or decentralization policies. Today we call the "hybrid local autonomy." British model is the hybrid local autonomy for harmony centralization and decentralization, French model is the hybrid local autonomy as to “Jacobinism appriviosé.”
