본 논문의 목적은 도덕 판단의 정당화를 위해서는 도덕적 회의주의 극복이 선결되어야 한다고 판단하고, 이를 위해 도덕 판단에서의 존재와 당위의 문제를 비판적으로 고찰하는 데 있다. 도덕 판단의 정당화와 관련된 문제는 도덕 교육에서 매우 중요하다. 왜냐하면 학생이 내린 도덕 판단에 대한 정당화는 행위자의 도덕적 신념의 표현이자 타인을 설득하기 위한 수단이 되며 도덕적 행위로 옮기려는 강한 의지의 바탕이 되기 때문이다. 따라서 본 논문은 도덕적 회의주의 극복을 위한 예비적 고찰로 도덕 판단의 정당화와 관련된 존재와 당위 문제에 대해 살펴보았다. 이를 위해 도덕 판단의 성격을 분석하고, 도덕 판단에서의 존재와 당위 문제와 관련한 흄의 법칙과 자연주의적 오류를 살펴본 다음, 이를 바탕으로 도덕 판단의 정당화에 대한 회의적 입장을 가져온 자연주의․직관주의․정서주의 윤리설의 주장과 그에 따른 한계점, 그리고 존재에서 당위의 도출을 부정하는 흄의 법칙을 인정하면서도 어떤 측면에서는 사실과 관련된 전제에서 당위적 결론을 도출할 수 있다는 푸트(P. Foot)와 서얼(J. Searle), 툴민(S. E. Toulmin)의 주장에 대해 비판적으로 고찰하였다.
Abstract
On assumption that the overcoming of moralistic skepticism should be done foremost for justifying moral judgment, the purpose of this paper is to conduct critical consideration of the issue of is and ought in morality. The issue concerning the justification of moral judgment is an assignment to be solved previously in ethics and also a very crucial issue to be solved in moral education. This is because ethics is studies related to right and wrong in actions, which is the key of moral education, questions about moral virtue and vice, and the existence of justification regarding this. All the more, this is because whether there is justification in moral judgment is very closely related to the existence of ethics and moral education based on ethics as one field of studies and as a curriculum. In order to discover whether there is justification in such moral judgment, first, it is necessary to understand the character of moral judgment. Moral judgment prescriptivity, universalizability, and overridingness. Regarding such moral judgment, the naturalistic theory of ethics, Foot, and Serale assert that it is possible to withdraw ought from is despite some difference. In particular, Toulmin insists that as a fact and a value are not in a dichotomically separated relationship, but are able to deduce ought from is because their relationship is somehow flexible. Meanwhile, Hume and Hare assert that it is impossible to deduce the moral conclusion of ought from the realistic presumption of is, and in order to withdraw moral conclusions, a presumption must include a statement of ought.
