Abstract
After Sea Prince oil spill case, most of national system for oil pollution was improved, especially in marine pollution response system. But, the Hebei Spirit oil spill case in December 2007, was essentially different from Sea Prince's. It was fatal accident that exceeds limited amount of compensation under the International Convention on Civil Liability for Oil Pollution Damage, 1992 and the International Convention on the Establishment of International Fund for Compensation of Oil Pollution Damage, 1992. In Hebei Spirit oil spill case, a greate problem was how to compensate for the victims, wherefore there were many arguments for legislative and legal interpretive problems of the Law of Liability for Oil Pollution Damage which has adopted two conventions, 1992. These arguments can be divided into several parts, legal system, early payment of prevention cost, full and rapid compensation and another legal interpretive problems of the Law of Liability for Oil Pollution Damage. This paper, by review of previous studies, try to study the validity of previous studies and suggest improvement of system.
