중국의 외자 진입 등록제도에 관한 소고

Abstract

Since 2013, there has been a great change in the procedural regulations for foreign investment management in China. As the comprehensive examination and approval system for foreign investments has been changed to a universal registration system, the registration system is being implemented for foreign investments that are excluded from the targets of negative lists. There are two types of registration system in China: a special registration system for service providers in Hong Kong and Macao, and a general registration system for all foreign investors. The special registration system went through the demonstration in the Guangdong region of China and spread to the whole country. The general registration system was converted to the whole country through demonstration in the free trade demonstration zone. The implementation of the registration systems implies a radical transformation of the foreign investment management system in China. With the enactment of the registration systems, the threshold of entry into China has been lowered, and the conditions for entry into China have eased enabling freer advancement into China. However, as the center of supervisory management of the Chinese authorities moves from the pre-entry stage to the post-entry stage, formal supervision and management are being transformed into actual supervision and management. At the same time, supervisory management is getting stronger and more rigorous, so our companies need to be aware of the changing Chinese investment environment and respond wisely.
