Abstract

In the short-term intensive economic growth process led by the government from the 1960s to the 1980s, the Korean government adopted a disproportionate growth strategy and provided various financial and tax privileges to a select few companies to grow into large corporations. Since the chaebol system has been established and the concentration of economic power has deepened, various regulations have been put in place to restrain the concentration of special economic power in the Monopoly Regulation Act in order to correct such a deformed phenomenon unique to Korea. One of them is the regulation on the restriction of the voting rights of financial and insurance companies. Recently, as the economic inequality in the Korean society deepens, social conflicts continue to appear. Therefore, it is necessary to improve the system for restriction of voting rights of financial companies as one of the national tasks to be solved as a way to alleviate social conflicts. In this way, the recognition that the efforts to improve the concentration of economic power is necessary under the banner of so-called economic democratization is becoming common. However, since this is closely related to the separation policy of financial capital and industrial capital, we will first examine changes in the separation policy and related systems of financial capital and industrial capital regarding the debate on economic democratization, and then open up the restriction on the voting rights of financial and insurance companies. In this paper, we will look into how the legal system for the restriction of voting rights of banks and insurance companies in Japan, which have similar contents, and their transition, and discuss implications for us.
